My Experience with Advocate Bhupender in Registration of my Plot

Hi All,

Yesterday, I was able to complete the registry of my plot with the assistance of Advocate Bhupinder and would like to share my experience about Mr. Bhupinder as below:

PROS:
  • He took only few hours to compile my set of documents that is required to be submitted to Authority for verification
  • He was able to complete my Registry work at Registrar office on same day.
CONS:
  • Appears to be greedy and tried to extract more money than agreed amount of 2,000 for authority work and 5,000 for registrar office work
  • I lost Rs. 18,500/- as stamp duty that was not required to be paid for PLC for plot located on 18m wide road, as I came to know later that as per Registrar office rule, stamp duty for PLC is applicable on plots located on more than (not equal to) 18m wide road, although we have to pay PLC charge to authority as per authority rule, but no stamp duty is required on it, as per Registrar office rule.
The advocate did not explain this to me and he was always saying that he can save my stamp duty money on PLC for which I need to share the amount with Registrar office through him. Thinking to be illegal, I did not agreed, but later came to know the correct rule, but it was too late as I already have purchased stamp paper of Rs 18,600/-  (Rs 100 is only required as I have already done my ATL earlier)
  • The advocate asked me to pay additional Rs. 5,000/- to be paid as bribe to Registrar office giving reason that since I have attached extra stamp paper of Rs. 18,500/- , there is objection from registrar office and in order to clear the objection they are asking Rs. 5,000/- as bribe. I refused to pay.
  • The advocate asked Rs. 500/- to be paid to authority officer signing my registry document at registrar office. I refused informing him that his service fee of Rs. 5,000/- includes these petty expenses at registrar office.
  • The advocate took Rs. 21,000/- for official payment to Registrar office, but the receipt he gave me only have value of Rs. 20,120/-
  • He took last instalment of his total service charge of Rs. 7,000/- on the day of registry, although the work is still incomplete as he has to get my original Registry documents from Registrar office after 10 days, as per registrar office norms.
CONCLUSION:
  • I have another plot for which I am awaiting letter as promised by authority in December 2019. I should approach another advocate to get only registry office work done for Rs 5,000/- as now I believe I can do the authority work myself.

Hence, taking your words at face value... I henceforth remove the name of Mr. Bhupender Bhati from the list of 4 lawyers provided as suggested lawyers by myself on insistence of may members of this group.

Mr Kamran,

I've also completed my registry. I understand from the person in charge of my sector in authority that in the total amount mentioned in the lease deed application one will not include the PLC and this way you dont need to pay any stamp duty on the PLC so I dont think there is any clause of  "plots located on more than (not equal to) 18m wide road" as it is applicable in all case. 

When you come to know that you have purchased extra stamp paper ,why you didn't  return it with refund. There is a process where owner of teh stamp paper can return the stamp paper even though those have been written with details at AGI office with 10% deduction.

Thank you so much Mr. Kamran Khan for sharing your experience and bringing forward so many facts regards registration and stamp papers .
Would be really grateful if you could help me know the amount of stamp paper required , I have a 500 sqmtr plot in sector 20 and I have been told by the authority that the plot is on 18 meters wide road and hence there will be preferential location charges amounting to ₹ 1,18,750/- ( which I have already paid) .
I have already done agreement to lease in 2010.
Will be going for registry of the plot in the coming week. I have already submitted all the documents with the authority for verification .
I have been told that I will be needing to purchase the stamp paper worth Rupees 9500/- along with the registrar fee of 20,100/- .
Your help in the above matter will be highly appreciated as I am trying to get everything done on my own.
Pls advise about the stamp paper required in the above case where o have already done ATL.
Also apart from the above expense is there any other expenditure or documents required.

Dear Mr. Kamran,

Why were you required to attach stamp papers worth 18,500 when single PLC attracts 7% worth stamp papers of the PLC amounting to 1,18,750, which is ₹ 8,400?

Also, I spoke to the lawyer during the day. He claims that he insisted you don't need to submit the stamp papers but you insisted on doing so as someone in the authority advised you. The lawyer even requested me to speak to your wife, who was present during each process.

Don't worry, I don't doubt you and naturally there is no way that I'll speak to anyone else. 

I'm no judge.

However, it is important that both parties should have their say. When one accuses someone, the other person should be able to present his side.

You had and have complete freedom to say what you wanted to say... unfortunately, since same opportunity is not available to the other party to your claims, no one can know what really took place.

Anyway, from next time... I HUMBLY REQUEST others to please present some supporting docs or some real proof before making any such claim.

Not justified to judge anyone based solely on one side's acquisitions.

I dealt with Mr. Saurabh Agarwal and my experience has been great with him. Till now, we have done first step of all the document preparation/submission at the authority and registry is still pending (due to me being out of the country). No complaints. Thanks Safal for the reference.

Dear Rajeev,

You may be fortunate that your dealing clerk in authority did not insisted to reflect the PLC amount in the Lease deed.

But my dealing clerk Sandeep Tiwari asked me to indicate the same in my lease deed (please see my below screen shot of lease deed which consist of Rs. 4,750 + 237.50 (being 5% as PLC for 18m road)  = 4,987.50 per sqm, and asked me to provide stamp duty for the PLC.

But my lawyer whom I paid service charge did not gave correct information that there is different rule in authority and registry office that authority is charging for PLC on 18m road but registry office is charging extra stamp duty only on plot above (not equal to) 18m road. My advocate was boosting that he can save my stamp duty of Rs. 18,500/- (as per his calculation ) if I share the money with registry office through him.

Dear Ms Dhamani,

Your situation prior to registry (Lease Deed) is same as was mine, i.e. PLC already paid for 18m road to authority and ATL already done earlier.

As per Registry office rule you DO NOT HAVE TO PAY ANT STAMP DUTY on the PLC being paid to the authority as the rule is different between authority and registry office.

As per authority rule we have to pay PLC for plot on 18m road which I understand from your email that you have already paid. DONE. But, as per registry office rule you DO NOT HAVE TO PAY ANY STAMP DUTY FOR PLOT LOCATED ON 18m ROAD, as as per registry office rule the stamp duty is paid for plot on above (not equal to) 18m road. There is a written rule in registry office for this which I have seen, and I will try to share the copy of this rule if I can get the same on my next visit after 1 week to registry office to obtain my registry document.

Authority office is punishing us by insisting us illegally to pay more stamp duty as we are doing work ourself without paying any money under the table to authority. Indirectly, they are taking revenge from us. I even paid Rs.12,500/- to authority for late registration although I submitted all documents to authority on 24 September 2019, 6 days prior to cut off date of 30 September 2019. On my insistence, they informed that 6 days is not enough for them to verify my document and invite for registry. The strange thing is that they issued penalty letter dated 30 September 2019 for penalty which is in record and in the file but I believe as per standard they should have issued the letter AFTER 30 September 2019, not on the cut off date.

Now you have to only pay Rs. 20120/- to registry office plus Rs100/- stamp paper, nothing else if you have only one PLC of 18m road and no other PLC of corner plot or park facing.

I missed to respond to other points raised in your email, which is as below:
  • There exist rule in registry office, a copy of which can obtained from the advocate (I will try to get the same in my next visit to registry office after one week, if succeeded, and post in the group) that stamp duty on PLC is only applicable on plots located on above (not equal to) 18m road.
  • From your email I understood that stamp paper can be refunded from AGI office after 10% deduction, but this was not known to me earlier neither my advocate advised the same when I confronted with him of being forced to pay additional stamp duty. I did discussed this with my advocate and he advised that there is no way to get refund on any additional stamp paper paid mistakenly.

1.Letter for registry
2.Stamp papers ( required amt.) & mentioned the details of allotee with plot & details of ATL i.e.date of ATL,jild no.,bahi no,doc.no ( mentioned in ATL 2010 stamp backside)also signed & thumb impression
3.photo of managers & allotee(to be pasted in first page of stamp) & also 2 witness photo in backside of first stamp
4.Lease deed forms( signed & thumb impression on bottom of page)
5.aadhar & PAN of allotee
6.I D of witness with photo
7.one letter showing image of plot with all sides to be given by authority office after checking of registry papers.
This set to be deposit for signature of manager in each page with stamp & after signature this set in duplication with photos of allotee+managers+witness to be pasted in one page(may be given by regustrar office) submitted to registrar office. There above mentioned 2 witness also required for biometric punching then they give one document for depositing regn.amt of 20120 for 300 sqm plot( to be signed in duplicate at backside by allotee)with your registry papers(printed details of jild bahi doc.no.etc.in backside of stamps).after depositing fee this document with receipt deposit in one counter(near fee counter)& they will give you receipt in triplication printed. After that counter man saying come after one week for registry papers with duplicate signed receipt.

That is all.

I also did my lease deed appn papers completed by the same adv.i.e.Bhupinder & i also realized that he was greedy as he asked for 3000 bt i refused and i give my reference as i m working in delhi court then it was fixed at rs.2000 then he said for depositing your appn.give 500 to my asstt.who deposit your appn.
In authority office his asstt.asked 300 more for one document as there was an objection in appn.which was not notice by adv.bhupinder so i paid 2800 in total. In view of this i decide nt hire this adv.for registry work.
But next time the same thing repeated as i hired one adv.who is roaming around authority office & he charged 7100 in which 5500 his fees & remaining as bribe for registrar office in different counters. Besides this he also asked for more but i refused with a promise that i contact him again in next visit for possesstion letter work for which he asked for 2500.
So from the above i realized if you have time you can do all paper work at your own & save your money.
One thing more i also paid 5800 as stamp duty i.e.5700 on PLC(park facing) & 100 regn.fee as told by the dealing hand Mr.Deepak(sec.20 block l m n o p) in authority.

Now i submitted my appn to the authority office for possession on 29.11 & i enquired from project deptt. & they said that in 15-20 days they recd.letter from property deptt. & after that it will take one month to issue physical possession letter to you.
This is all i experienced.

As I was depending on the advise of my advocate Mr. Bhupender, he gave me calculation for stamp duty on PLC as below:

PLC amount 2,37,500 x stamp duty @ 7% x enhanced by 1.1 = 18,287.50, rounded to 18,500/-

The enhancement and rounding was advised by advocate, as per him this is registry office norm, so I believe on him and gave him the money to purchase stamp duty of Rs. 18,500/- which he purchased. 

It is true that the lawyer insisted me not to purchase this extra stamp duty as being asked by authority clerk (it is separate issue that authority clerk was giving me hard time as I was not pleasing him), but the lawyer did not informed me the correct rule but instead boosted that he can save this money subject to sharing the amount through him with registry office. I feared this to be illegal and that in future I will be caught by audit and have to pay penalty in addition to actual stamp duty, so I elected to purchase the additional stamp paper. 

The only written proof I have is the note taken by me infront of the advocate for additional stamp duty calculation as appended below:

In addition to the above, may I know if you were able to discuss, and the advocate's response on other issues raised in my earlier email related to his additional demand of Rs. 5,000/- for registry office, Rs. 500/- for authority official (these all I refused to pay), Rs. 21,000/- he took from me instead of Rs. 20120/- and taking his entire service charge of Rs. 7,000/- although the work is still incomplete as the final registry paper will be given to me after 10 days.

 Can you kindly advise as to how much stamp paper I am required to attach .
I have a 500 sqmtr plot in sector 20.
The plot is on 18 mtr wide road and hence i have paid PLC charges of 1,18,750/-.
The ATL has been done already in 2010.
As I am trying to do the registry of the plot on my own , will be really grateful if you could advise me with exact stamp paper required as there seems a little confusion regarding the same .
As mentioned by one of the members in the earlier mail I read that no stamp duty is to be paid on PLC ( if the plot is on 18 mtr wide road) pls let me know if this is true.
I was told that I will need to buy stamp paper worth 9500/- and also 20,100 will be the registrars fee.

Kindly advise .

These are calculations for 2 PLC. Does you plot have 2 PLC?

It appears from letter of Kamran Khan that stamp duty on PLC amount is not required to be paid. I also didn't know this and have paid the stamp duty. As per my knowledge everyone is paying the stamp duty. I shall request all those to come forward  who have not paid for the benefit of those who still need to get the registration done. I shall request Safal ji also to check if stamp duty on PLC is required to be paid or not so that one can fight if not required to be paid.

Dear Karan Khan first of all congrats for registry..... Thanx for sharing your experience at YEIDA office and with the lawyer... I just want yo ask that my plot 300 sq. Meter is in pocket 1(A), may be it's on 18 m Road only and no other PLC etc I am also interested to do my registry but do not want it hire a lawyer. 
1. What is the procedure and 
2. what documents are required. 
3. From where could I get the registry and deed language drafts.
4. How to submit at the office of registrar office

Dear Mr Safal,

Mine is 1,000 sqm plot and therefore the below calculation is for 1 PLC, calculated as 4,750 x 1000 x 5% = 2,37,500 being paid to authority.

For registry office stamp duty calculation, the above PLC amount is taken in consideration, although this stamp duty should not have been applied on my plot as it is on (not above) 18 m road. Otherwise, for registry office stamp duty for 1 PLC for 1,000 sqm plot is calculated as given in my below email as

PLC amount 2,37,500 x stamp duty @ 7% x enhanced by 1.1 = 18,287.50, rounded to 18,500/-

Thank you so much for your quick response.
 I had visited the authority office on 9th December 2019, and I was told the same thing as told to you , that I will have to pay a penalty amount as my last date for getting the registration done is 16th December 2019. ( 180days from the date of issuance of letter for getting the lease deed done - the letter was dated 19-6-2019) and that in 5 days they can’t process the documents submitted to the aunthority for getting the lease deed registration.
Though I feel that if this was the case then they should have mentioned it clearly in the letter that we need to submit the documents well in advance so that the authority has enough time to check them . I feel I had submitted the document well in time and hence should not be required to pay the penalty as demenaded by the authority.


I have two queries 

1) Did you pay this above stated penalty amount for late submission of documents.( which was actually well in time and not late)
Is there any way I can avoid paying this penalty.

2) In Lease deed copy submitted to the authority for verification they asked me to mention the PLC amount which is 1,18,750/-( attaching the copy of the same ) 



Do I need to mention this amount in the lease deed as you had mentioned that I do not require to pay any stamp duty on the above PLC .

Dear Mr Anand,

Based on my experience, I would like to clarify on applicability of stamp duty on PLC as below:
  1. The stamp duty on PLC is not required only for plots located on 18m road
  2. For other PLCs such as corner or park facing plot, I am not sure on the requirement of stamp duty as my plot was not having these PLCs so I did not gathered information about it. But it is my logical assumption and only assumption that stamp duty for PLCs for corner or park facing plot is required. 
The reason for 18m road not attracting stamp duty on PLC is a single word "above" appearing in registry office rule book that saved our money. It says that plot located above 18m road shall required to be paid stamp duty for PLC. This may be blessing from God that the typist or bureaucrat inserted the word 'above' in the PLC rule for stamp duty. On the other hand, in authority rule, it says that plot on 18m or more road width shall require PLC.

Since the amount of penalty was only Rs. 12,500/-, and in order to get the work completed, I paid the penalty. 

If you have patience and time you may get this waived by writing letter to authority with proper attachment and uploading receiving copy of the same with its attachment on Jansunwai portal of UP govt. It is very much effective tool.  
Authority was giving me hard time by not giving me zero period benefit and asking me to deposit additional Rs.1,40,000/- that I gained from Zero period. As the amount was more, I complained on Jansunwai portal and in 1 week of my complain, they asked me to come for registry without depositing additional amount of Rs. 1,40,000/- as instructed by them earlier. Thus, authority signed my registry paper.

Yes they also asked me to indicate PLC amount, as appended below. I do not see any problem in mentioning it in the lease deed as being asked by authority. As I explained earlier, as long as the PLC is for 18m road there is no stamp duty required. Please note that if the PLC is for other reason suchas corner or park facing, the stamp duty may be applicable, I am not sure, as I do not have these PLC and therefore did not tried to know about it.

The process of registry can be divided in 2 stages.

Stage 1 : Submit the documents to authority for verification
Stage 2: Upon verification by authority of the submitted documents, they should issue letter inviting for registry. In my and most of the case the letter is not received by allottee so after 10 days visit to authority enquiring about the status of the submitted documents and if they are not able to find any excuse, they will ask you to come in 2-3 days for registry.

Documents set required for stage 1:
A) Get the covering letter typed or hand written as per attach attachment A of this email
1) As mentioned in the covering letter, the attached documents to covering letter is 'Lease Deed' that can be obtained from authority website on the link http://yamunaexpresswayauthority.com/sites/default/files/uploads/leaseformat.pdf. I have attach my Lease deed as attachment 1 to this email.
2) Attach affidavit as per attachment 2 to this email
3) Affix 4 passport photo of allottee on A4 size paper, have 2 nos signature of allottee on this paper and get the photo and signature attested by bank.
4) Copy of ID of allottee
5) Copy of challan of all payment made 
6) Copy of challan of PLC charge (if applicable) and Lease rent
7) Passport photo of 2 witness (which is already fixed on back side of first page of lease deed) and their ID copy attached to lease deed.
8) Copy of ATL done earlier

Please note that registry stamp paper is not required at this stage. After compiling the above documents, go to authority office and at ground floor there is department named 'CR Cell'. Submit all the above document there. I carried only copy of covering letter (attachment A above) on which they put receiving stamp with date and serial number. You can make copy of entire set of above documents for your record. 

After 10 days, go to authority and enquire about the status of documents submitted. if they are not able to find any excuse, they will ask you to come in 2-3 days for registry.

Documents set required for stage 2:
1) If there is no stamp duty required due to ATL done earlier and PLC stamp duty not applicable, get Rs 100/- stamp paper, affix photo of authority signatory (available with any person on payment of Rs. 50/-), develop (re-type as original) and attach the Lease deed only, same as submitted in stage 1 earlier (attachment 1 only of stage 1), make one additional set and go to authority office with 1 original and 1 copy of the set.
2) The authority will give A4 size original plot layout. Make 2 copies of the same and attach to each set. Note that original plot layout should not be attached and kept for future use during possession.
3) Same day, authority manager (authorised signatory) will sign each page of lease deed and hand it both original and copy to you.
4) Rush to registry office with the 2 signed set of lease deed, attach copy of ATL and submit to registry office.

Please note that as my documents of stage 2 is still with registry office, and as I do not have copy of the same, I am unable to provide its copy. Also, as my work was done by advocate in registry office, I am unable to provide detail of various windows / table which my advocate took the document for signature in registry office.

Below are the charges mentioned to me by one of the lawyers for doing registry of 300 meters.

ATL done for this plot:

1.)      1,42,500/- lease rent , 7,125 - location ( plot is on 18 meter road )  - Total 149625/-
2)       71,250/- location charges    ---> Not sure what are these?


DD in favour of YEIDA 

Stamp paper
100/- general + 5,600 - location 

20,500 /- registry 
6,000 - Charges 

Can someone please suggest if these are correct. I have read previous post and didn't found any one mentioned charges in the name of "Location Charges "

Hi Guys,

I also executed leese deed of my plot. Just want to share my experience. I managed paper work (documents required) my self. I got connect with Mr. Sanjeev and he has taken 3000/- rs for 300 meter plot for registry office work.

Aside that 20500 (fee)+100(some different fee if ATL done)+200 (2*100 for 2 person sitting in registrar office).

Overall it was quick...

Dear Nitin ji,

During the Lease Deed process, I also faced hard time from the authority staff sitting on first floor. After making 2 -3 rounds and paying additional government fee in terms of late fee and stamp duty, which I later found to be wrongly instructed by authority staff for harassing me, as I was not ready to pay any bribe to them.

I registered my complaint online on UP government portal http://jansunwai.up.nic.in which was very effective and only due to my online complain my work was completed.

I suggest You and others who are facing harassment by authority staff should lodge online complain on http://jansunwai.up.nic.in, narrating as much as possible the sequence of event happened as a story and attaching a documents such as receipt copy of CR cell obtained during submission of document.

During my follow up to authority office I found that they can't ignore the online complaint and have to lodge it with date in their register and also record the action taken by them, with date. There is time limit to close the complain by authority and so they can't delay it. There is also reminder option in online portal in which you can send reminder after time limit is passed.

After closure of my complain, I even receive call from CM office enquiring if I am satisfied by the closure action taken by the authority.

On registering my complain, when I went to authority office after 2-3 days, the same guy who was earlier not entertaining me was very courteous and even the property manager became polite and told me politely that I should have came to him instead of registering the complain online, although I had went to him earlier several time.

In addition, I emailed same content of my online complain to 5 -6 key officials of authority starting from the chairman, CEO, etc,  the email of whom are listed on authority website at http://yamunaexpresswayauthority.com/keyoff.html
