The best solution of gettig rid of this GST on installments of a leased or rented property is to ask the authority to convert the leasehold property (our plots) in to free hold property. Authority can charge for conversition of our property to freehold, instead of charging the Agreement to lease amount.

The clarification given by Greater Noida Authority is wrong as the installment paying to authority is the cost of land which is not liable to GST. Whether, Authority paid the GST to Govt on buying land from farmers. In the same way , Authority allot the land to General Public on the basis of no loss no profit with the ownership with the authority and Allotee is the lease holder. Authority claims only lease rent which is the element liable for GST. It means GST is payable only on the lease rent instead of Cost of leased land
