The reaction of NYRI to the ruling supporting the NY law preventing
them from using eminent domain to take adjoining property along the
proposed power transmission lines.

They are depending on the federal level to help out, of course. If
the Public Service Commission finally gets a chance to say yay/nay
they will still have the option to bring their plan to FERC.

Watch for more news in the next few weeks.... as they submit more
info to the New York Public Service Commission.

PAST: A federal judge dismissed a lawsuit last week by New York
Regional Interconnect that challenged a state law intended to protect
homeowners from the use of eminent domain by private transmission
companies.

NYRI has proposed building a 1,200-megawatt power line through South
Utica, New Hartford and the Sauquoit Creek Valley.

PRESENT: NYRI is disappointed in the ruling, spokesman David Kalson
said. The lawsuit was dismissed on procedural grounds, not on
substance of the argument, he said.

FUTURE: In the next few weeks, NYRI will be submitting supplemental
filing to its pending application with the state Public Service
Commission.

The additional filing will include more extensive studies of
alternative routes as well as detailed economic and environmental
impact studies, Kalson said.
