  Judge dismisses NASCAR counterclaim against teams, could a settlement be coming? (NASCAR Cup)
One of the biggest weeks of NASCAR’s season is well underway. And days before a champion is set, the court case drama that’s bubbled under the surface all year has again seen new developments.
The sanctioning body argued that 23XI co-owner Curtis Polk illegally colluded with other teams during charter negotiations during 2023, claiming that a boycott of the team owners council meeting negatively impacted its media rights organizations.
Bell ruled that the boycott was a negotiating tactic which seemed to have minimal impact and declared that the teams didn’t participate in “unreasonable restraint of trade,” noting that the teams working together over charter negotiations that were equal for all involved was understandable.
“The evidence here establishes that not only were individual negotiations ‘available,’ but NASCAR had such negotiations regularly during the negotiation period,” Bell wrote. “And, those individual negotiations achieved concrete results, including the final 2025 Charter agreement that was signed by 13 teams acting individually (and contrary to the supposed ‘joint agreement’).”

There have been few developments to suggest an amicable settlement is coming before the scheduled Dec. 1 trial date, when NASCAR and NASCAR CEO and chairman Jim France would face off against 23XI Racing and Front Row Motorsports. That 23XI’s ownership group includes NBA legend Michael Jordan and championship-contending driver Denny Hamlin, only heightened the stakes.
However, over the past week, the case’s outlook has changed, and a settlement could be announced this week.
This is based on interviews with eight team owners and executives, as well as two league officials, who were granted anonymity so they could speak freely about ongoing tense negotiations. They shed light on a process that seemed headed for a resolution during a two-day settlement last week, only to break down in the final hours. Now, one of NASCAR’s top executives is making a push to strike a deal in advance of the league’s championship race this weekend in Phoenix.

 Sam Mayer penalized for post-race crash at Martinsville (NASCAR Xfinity)
The NASCAR season is set to wrap up this weekend at Phoenix Raceway, but Sam Mayer’s offseason is already underway.
Haas Factory Team (HFT) has elected not to appeal the decision. Xfinity Series veteran Ryan Sieg will take Mayer’s place in the No. 41, with Kyle Sieg taking his usual ride. RSS Racing plans to announce a replacement for Kyle’s No. 28 today.
“We remain focused on finishing the season out strong at Phoenix Raceway and look forward to contending for a race win with Ryan Sieg at the wheel,” HFT said in a Tuesday statement shared on social media.
Mayer was the headliner, but wasn’t the only person suspended on Tuesday. Rick Ware Racing saw two suspensions tied to a right rear wheel that fell off Cody Ware’s car during Sunday’s race. Jackman Dequan Hampton and rear tire changer Marquill Osborne will be suspended for both Phoenix and February’s Clash at Bowman Gray Stadium.
