NASCAR trial continues with testimony from Jenkins, O’Donnell (NASCAR Cup)
The ongoing antitrust suit between NASCAR and two of its teams finally put emphasis on the second organization suing the company Wednesday,
as
Front Row Motorsports owner Bob Jenkins took the stand.
Jenkins became the third witness in the lawsuit, telling jurors about his lengthy tenure as a Cup Series team owner and an alleged average loss of $6.8 million it brings him per season. He described FRM as “the team that has done the most with the least,” fueled
by his passion for racing and funded through success in other business ventures.
When asked why he took part in the suit, Jenkins said he took offense to NASCAR’s calls for teams to cut costs, alleging that his group was already operating as lean as it could. The Tennessean claimed to take part in the charter system because of a belief
in the value it could bring teams if executed correctly.
NASCAR attorney Lawrence Buterman accused Jenkins of hiding expenses that could have made Front Row look better behind his other ventures, citing the use of Long John Silver’s - which is owned by his sons - on unsponsored cars. Buterman also noted the minimal
8.5 percent of team revenues Jenkins pays to his drivers. Jenkins noted the costs of maintaining a team relative to other sports as a justification.
Before Jenkins took the stand, NASCAR’s Scott Prime finished his portion of testimony. Team attorney Jeffrey Kessler used his communications over the years - both within NASCAR and as a member of the consulting firm McKinsey beforehand - to spotlight allegations
of monopolistic abuses from the series. Kessler then called out NASCAR’s goodwill provision in the charter agreements, which effectively banned participating owners from owning a team or investing in a competing stock car series within a year of leaving the
series, adding later that NASCAR’s rulebook says teams can’t use the Next Gen car for any other series.
Prime said the rulebook provision was merely following standard IP practice. He defended NASCAR’s goodwill provision and later challenged the teams’ demand of $20 million per car in revenue payouts, noting that it would effectively bankrupt NASCAR.
Thursday
brought the end of Jenkins’ final words followed by the testimony of NASCAR President Steve O’Donnell, with an emphasis on NASCAR’s apparent concern about the short-lived Superstar Racing Experience in 2022. Coming amid early charter discussions and
while LIV Golf was threatening the PGA with Saudi backing, SRX provided an example of a tour teams could participate in should they choose to breakaway from NASCAR - an image amplified as several Cup stars and team owners Denny Hamlin and Justin Marks partook
in SRX races.
NASCAR’s concern led to exclusivity clauses for many tracks, preventing other stock car series from racing at venues across Speedway Motorsports’ portfolio and at independently-owned tracks. Meanwhile the charter discussions led NASCAR to consider everything
from giving teams a deadline to sign a new agreement to abandoning the system altogether and taking the operating of teams in-house.
SRX has since vanished, but O’Donnell admitted that he “thinks about” a potential breakaway series “every day” as he looks at headwinds NASCAR could face. That said, O’Donnell was comparatively pro-team to others in the sanctioning body, as indicated by his
texts and emails during charter discussions.
Throughout NASCAR appearances on the stand thus far, Kessler has painted the sanctioning body as a group held back by the Board of Directors - and namely Jim France, who seemed to shoot down many potential compromises over the course of the charter negotiations.
Kessler tried to get O’Donnell to single him out, but the NASCAR President was careful to avoid doing so.

The biggest news off-track in NASCAR this week is the trial. But when it comes to on-track results, the most seismic shift may have just occurred quietly behind the scenes.

Jenna Fryer confirmed during a break in court that Joe Gibbs Racing’s Competition Director, Chris Gabehart, has departed from the company.
Gabehart has become one of the biggest names outside of the cockpit in recent years, having earned 22 wins as crew chief of Denny Hamlin between 2019 and 2024, including a pair of Daytona 500 victories. He was promoted to the Director of Competition role for
2025, helping to guide JGR to a strong year that saw both Denny Hamlin and Chase Briscoe make the Championship 4. He also began to work with Ty Gibbs after the grandson of team owner Joe Gibbs struggled early in the year.
It’s uncertain where Gabehart could go from here, though the logical expectation would be for him to make a leap to another team. Neither Gabehart or JGR has released anything publicly in the hours since Fryer confirmed his exit.

FIA election to go on as planned amid legal squabble (F1)
The FIA’s presidential election has been contentious and is subject to legal proceedings early next year.
But
for now, the election will continue on as planned.
Swiss racing driver Laura Villars was among the potential contenders, but fell out of contention due to a unique quirk in the governing body’s election rules that prevents anyone from running without support from a specific slate of potential vice-presidents
from various FIA global regions. South America had only one potential candidate - Fabiana Ecclestone, wife of ex-Formula 1 leader Bernie Ecclestone - and she’d pledged her support to the incumbent Mohammed Ben Sulayem.
Villars has launched legal action against the FIA and sought an emergency judgement from a Paris court to suspend the election. But it’s scheduled to take place as planned on Dec. 12, handing Ben Sulayem a second four-year term in the role.
“The French Court has issued its decision on 3rd December, confirming that the election for the President of the FIA will proceed on 12th December at the FIA General Assemblies in Tashkent, Uzbekistan,” an FIA statement read. “The FIA remains focused on the
forthcoming General Assemblies and discussing with its member clubs globally important issues for both motorsport and automotive mobility.”
The litigation is ongoing, with a hearing scheduled for Feb. 16, 2026. Results of next week’s election could be annulled pending the conclusion of the legal proceedings. But for now, the presidency is again Ben Sulayem’s to claim.
