Suing teams score another win as NASCAR suit nears (NASCAR Cup)
For the second time in as many weeks, Judge
Kenneth D. Bell has ruled against NASCAR in its antitrust battle with 23XI Racing and Front Row Motorsports.
In a summary judgement - a pretrial decision with no dispute over material facts - Bell ruled that the market in question with the teams’ case is ‘premier Stock Car racing’, declaring that NASCAR has power over the market. It’s the second big win for the teams,
following last week’s decision to dismiss NASCAR’s counterclaim over alleged illegal collusion of Curtis Polk with other race teams over charter terms.
In essence, Tuesday’s ruling means NASCAR’s argument that the teams could compete elsewhere is null. This backs up the teams’ argument that there’s no room for a competitor in the market, with NASCAR owning the bulk of its tracks and controlling how much teams
spend through its designated single-source suppliers for the Next Gen car. The sanctioning body had previously argued that teams could compete in other tours, from Formula 1 to IndyCar.
“NASCAR argues that the relevant market that it alleges for its Counterclaim – in nearly the same words as Plaintiff describes their relevant market – is somehow not the same market,” Bell wrote in ahis Tuesdays ruling,. “A simple example should suffice to
show why NASCAR can’t play the same hand twice in different ways.
“In pursuing its Counterclaim, NASCAR argued that the Plaintiffs had market power in the relevant Cup Series market because it could not reasonably substitute IndyCar or Formula 1 racing teams or even the racing teams participating in its two lower level series.
... However, in opposing Plaintiffs’ relevant market, NASCAR now contends that the same motorsports that could not supply racing teams to the Cup Series are suddenly readily available substitutes for the Cup Series teams like Plaintiffs to sell their services.
Not only is it illogical, but there is no record evidence that racing teams in the various motorsports can only move from NASCAR to another motorsport but not vice-versa.”
Tuesday’s ruling will tighten the scope of the upcoming trial, set to begin on Dec. 1 in the absence of a settlement. The trial will be focused on NASCAR’s monopsony power to impose unfavorable terms with its Charter agreement - and whether the charter agreement
itself may be anticompetitive to begin with. Bell considered that notion in Tuesday’s ruling, writing that “there is also evidence in the record from which the jury and/or the Court could conclude that the Charter agreements themselves are anticompetitive
restraints on trade with respect to Cup Series aspirants who don’t have Charters.”
Unsurprisingly, 23XI and Front Row released a statement saying they were “very pleased” with the Court’s Tuesday decision. NASCAR also released a statement claiming it was looking forward to “proving that it became the leading motorsport in the United States
through hard work, risk-taking, and many significant investments over the past 77 years.
“The antitrust laws encourage this—and NASCAR has done nothing anticompetitive in building the sport from the ground up since 1948,” the statement continued. “While we respect the Court’s decision, we believe it is legally flawed and we will address it at trial
and in the Fourth Circuit if necessary. NASCAR believes in the charter system and will continue to defend it from 23XI and Front Row’s efforts to claim that the charter system itself is anticompetitive.”
License point quirk keeps Connor Zilisch from Bahrain Rookie Test (Sports Cars)

Zilisch lost more than just a trophy when he dropped the NASCAR Xfinity Series championship to Jesse Love on Saturday night.
Reports emerged Tuesday that Zilisch has lost an opportunity to participate in the FIA World Endurance Championship’s Nov. 9 Rookie Test in Bahrain. The Trackhouse Racing star was expected to test with Cadillac Hertz Team JOTA as an award for a memorable season,
but won’t be eligible due to a quirk within the rules for the test.
Because of his championship loss, Zilisch fell short of securing the required number of ACCUS license points to test the Hypercar he was intended to drive. Much like the Formula 1 superlicense points structure that’s plagued ex-IndyCar driver Colton Herta,
the FIA’s sports car license structure favors its own series and offers limited point allotments to series like NASCAR’s second tour.
That doesn’t mean the 19-year-old won’t get any time in a top flight sports car, though. With IMSA’s comparatively friendly requirements, Zilisch is reportedly expected to be on the provisional entry list for IMSA’s Daytona Sanctioned Test with Action Express
Racing, opening the door for a GTP drive in the Rolex 24 at Daytona.
Racing in sports cars would be nothing new to Zilisch. He was an LMP2 class winner at just 17 years old in the 2024 Rolex 24 with Era Motorsport and followed that win with a triumph in the Twelve Hours of Sebring. He returned to the Rolex 24 in a Chevrolet
Corvette Z06 GT3.R with Trackhouse and TF Sport this January.
The Bahrain Rookie Test is
set to feature 26 cars across the Hypercar and LMGT3 classes, providing teams a chance to assess talent ahead of the 2026 season. Numerous drivers have been revealed for the test thus far, from Jack Aitken to Lilou Wadoux.
