--II. A. Give Virginians Remedies for Fraudulent Foreclosures
Did you know that some Virginians are fraudulently foreclosed upon?
They lose their homes to foreclosure, even though they have paid their
mortgage. Foreclosure fraud is a real problem with terrible
consequences for families. In Virginia, most people are protected
against fraud by the Virginia Consumer Protection Act, but there are
limitations. Because of the element of Virginia’s fraud law and the
differing opinions on how it applies, no adequate remedy exists to
help homeowners harmed by these fraudulent practices.
SB 163 would give individuals and families the ability to bring legal
action against those who commit the fraud and to collect actual and
punitive damages. This bill makes clear that homeowners who have been
harmed can obtain a remedy against someone who knowingly uses
fraudulent documents to pursue a foreclosure.
Homeowners must go to Circuit Court to stop a fraudulent foreclosure
and doing so almost always requires hiring a lawyer. Senate Bill 163
would make the guilty party pay for the lawyer if ordered by the
court. Otherwise, there is no incentive for a lawyer to take the case
and pursue justice for the homeowner in court.

--II. B. Mortgage Settlement Funds Should Focus on Housing
Virginia will receive a direct, onetime payment of $69 million from
the national Mortgage Settlement Agreement. The funds are essentially
unrestricted in their use although its encouraged to be used for
housing.
In the next few days, your elected officials will be deciding how to
use this $69 million. The Virginia Interfaith Center asks you to
contact your elected officials and tell them it should be used on
housing. The Mortgage Settlement came about as a result of the damage
that mortgage abuse did to families and to our housing market. The
funds from the settlement should be used to help families avoid
foreclosure, obtain decent, affordable housing, and to address vacant
and blighted foreclosed properties that are a liability to
neighborhoods and a drag on our housing economy.
Send a message to your delegate and state senator that you want the
Mortgage Settlement Funds to be used for housing!
