to Right to Recall Group
Dear All,

The Bhopal verdict needs no description. It is more than clear that
the judges from magistrates to Supreme Court Chief judges all queued
up to sell themselves, along with Ministers and investigation
officers. They all traded away some 15000 dead bodies and many
injured.

Back when tragedy occurred, Anderson was arrested and presented before
court. Within hours, the judge issued bail !! As the rumor mill says,
he got direct instruction from Supreme Court judges to issue a bail to
him on ASAP basis. The prosecutor demanded that he should be at least
put under house arrest. The judge refused. Then prosecution demanded
that Anderson's passport should be impounded. One can only guess how
much bribe the judge took to issue such simple denials.

Then came SC-Cj Pathak who wanted to become judge in International
Court of justice, Genev and he needed US support for that. So he too
sold out and gave pittance of compensation.

And finally, we have magistrate Tiwari, Chief Judicial magistrate,
Bhopla, selling out. He issued prison sentence of only two years to
all seven accused. And within 1 hour, each of them got bail and were
free men. What is next? HCj will take bribe and supresss the case of
10 years and then SCjs will take bribes and supress the case of
several years? And then once they are dead, SCj will punish them !!
Just like Harshad Mehta who was imprisoned by SCjs, but some 2 months
after he died.

What can reduce to this rampant bribery in judges from magistrate to
Supreme Court Chief judges?

I have proposed several laws such

1. Right to Recall judges from Magistrates to Supreme Court Chief
judge : In any country where citizens have procedures to expel judges,
the judges may still take small bribes but will not dare to trade over
several dead bodies. And recall law is MUST. Without Recall, the
Indian judges have degenerated to an extent that judiciary can never
be improved without citizen's direct intervention.

2. Recruitment by written exams : As of now, all judgesbecome judges
via interviews and so rampant corruption and nepotism prevails. It is
now open that only relatives of judges, Ministers and eminent
intellectuals etc can become judges. And the people who become judges
by nepotism then favor their relative lawyers and thus corruption and
injustice increases. So recruitment should be strictly by written
exams only

3. Jury System : Most judges will openly favor their relative lawyers
and Jury System kills this nepotism. One correlation is easy to see :
All corruption-free countries have Jury System and only the countries
with Jury System have low corruption with just 2-3 exceptions.

In addition, I have proposed many changes at http://rahulmehta.com/improve_courts.htm
.

How can these changes be brought? By forcing PM, CMs and Mayor to sign
on the proposed RTI2 law given in this petition http://www.petitiononline.com/rti2en/
. The law simply says : if a person demands, his complaint against
corruption should come on the website of Prime Minister. How will such
simple change reduce corruption in judges? This is explain in
http://rahulmehta.com/001.pdf .

How can we citizens force PM, CMs and Mayor to sign this RTI2 law?

By spending as little as 10 minutes to 1 hour a week, you can assist
pro-recall people in bringing Right to Recall laws in India. How? What
actions are so that mere 10 minutes to 1 hour will suffice? It is
explained at http://rahulmehta.com/003.pdf .

In case you disapprove the list of activists mentioned in above PDF, I
have no problem with that as long as you are spending at least 1 hout
a week in activity that you think will reduce corruption in Ministers,
officers, judges. If corruption in judges, Ministers, officers,
policemen etc doesnt reduce, then criminals will become bolder and
bolder and will do more and more damage. If you are not against
corruption of Ministers, officers, judges etc then you are with
corruption in Ministers, officers, judges. You are taking India closer
to its grave.

Regards,

-Rahul Mehta
