THE ISSUE:  THE GEORGIA SENATE IS VOTING ON MONDAY MARCH 19TH TO RAISE
YOUR HOA DUES IN ORDER TO HAVE EVERY MEMBER PAY WHEN YOUR NEIGHBOR
SELLS HIS HOUSE   
  • Did you know that the Senate Judiciary, backed by special interest groups, has been pushing to pass a bill that will negatively affect YOU as a homeowner living in an association? 
 
  • House Bill 410, as it was just passed by the House earlier this month, currently stands at a fee cap of $250 for closing packages, which is the average cap for all 10 states with this legislation.
 
  • The Senate Judiciary members are proposing and voting on a substitute bill to House Bill 410, which caps fees well below the cost that associations and their management company incur to produce important information required for homeowners when selling a home in an association.  
 
  • The Senate is proposing to amend this fee down to $100, which will shift the cost to allhomeowners, causing association dues to increase to pay for your neighbor's transaction.
FACTS YOU NEED TO KNOW:
  • As you know, your association is a not-for-profit organization, and is funded by only your assessments.  If the politicians amend House Bill 410, it will result in a cost that must be absorbed by all other homeowners (YOU). 
 
  • The fee associated with disclosure documents reflects the time, labor and the liability associated with producing critical information about the specific homeowners account and association, as well as handling multiple calls and emails from realtors, lenders, appraisers, and closing attorneys to facilitate the transaction.
 
  • These packages are needed at closing to educate new owners as to their rights and responsibilities of living in a mandatory association. 
 
  • Our elected officials should not be swayed by the special interests of lobbyists at the expense of their constituents.  Urgently contact your elected officials and ask them to stay out of homeowners' pockets.
URGENT ACTION NEEDED:  The Senate Judiciary Committee will vote on this bill and the proposed amendment on Monday, March 19, at 4:00 p.m.  Please urgently show your concern for this bill on Monday by:
  1. CALL, EMAIL and USE TWITTER to contactALL members of the Judiciary Committee (list provided) with the message – "Don't Amend HB410 – Approve the Bill As Passed By The House"
