Dear Commissioners,

As the United States entered the 1930s, though most cities and larger towns had been connected to the growing electricity grid, rural America, including much of North Carolina, was largely excluded from that resource, which was increasingly essential to full participation in America society and economy of the time.  Only about 11% of rural areas had electricity.

Pres. Franklin Roosevelt under his New Deal created the Rural Electrification Administration to help rural America become integrated into the larger American society.  Within about 10 years, about 90% of the nation had been wired, no doubt, including much of North Carolina.

More recently, Orange County realized that a similar effort was needed to ensure that all the county was fully connected to the internet with fiber optic cable, a very positive endeavor.  Today’s internet is now essential to full participation in American society and economy.

The agenda for the 16 Sept 2025 meeting of the BOCC notes that this project supports three goals of the county’s strategic plan:

·      Goal 5, public education and learning community

·      Goal 6, a diverse and vibrant economy

·      Goal 2, a healthy community.

The county engaged with North State Communications, now Lumos, now part of a multi-billion dollar company, T-Mobile, to bring cable to underserved and unserved areas of the county.

But now, Lumos/T-Mobile is asking the county to alter its contract to exclude over 500 homes in areas previously promised to have this better form of internet.  These homes include those in Southwest Orange County and other areas.  T-Mobile had total revenue in 2024 of $81.4B, net income of $11.3B, and total assets of $202B.  The company has the resources to finish their commitment.

If the County agrees to Lumos’ request, it will be abandoning its promise to residents in Southwest Orange County and other areas, in hopes of maybe, possibly receiving state money.

Please insist that Lumos/T-Mobile fulfill its responsibility.  ALL of our county deserves high-speed fiber optic cable.  If you accept Lumos/T-Mobile proposal, you will be trading a legal contract for mere hopes, and backtracking on your own commitments.

Mr. Dalton,

On behalf of the Board, thank you for sharing your comments and concerns regarding internet access and the proposed amendment to the grant contract with Lumos. The Board will consider an amendment tonight during our meeting at 7 pm at Southern Human Services on Homestead Road. Here's the link to the agenda:  http://server3.co.orange.nc.us:8088/WebLink/Browse.aspx?dbid=0&startid=76599&row=1&cr=1

Total contract:  $40 Million - $30 M investment by Northstate/Lumos and $10M from Orange County ARPA federal funds.
OC would pay Lumos $1M to start, $3M more after 3,000 passes completed and the remaining $6M after the total 6,370 passes are completed.

Only unserved or underserved houses could be covered legally using these ARPA funds. Many have inadequate internet, but still do not qualify under these terms for ARPA funded coverage. Other providers sat with staff and went through the addresses one by one on this issue.

In 2024 difficulties slowed progress and this summer Lumos reported that they have spent over $20M more than agreed upon ($50M+) and need to reduce the number served. To-date, 5,187 passes completed (81.4%) and $4M ARPA funds paid to Lumos.

The contract is not in breach yet. The remedy if the 6,370 passes are not done is that Lumos does not get paid the remaining $6M. That's how an incentives/grant type contract works.

And, the ARPA rules mean the only other use would be for very similar fiber installation, but 1) there is no time for a different rfp; 2) there is no other government doing this type of project for OC to transfer the funds so 3) if unused, the funds revert to the federal government.

The final deadline is 12/31/26 to fully expend the remaining $6M.

The amendment proposes that another 665 passes be constructed, a reduction of 518.  The revised payout schedule is:
199 new passes and OC pays $2.6M (recognizing the large increase from 3,000 to 5,187 completed since the last payment).
111 more new passes and OC pays $1.3M.
final 355 new passes and OC pays $1.3M.
That sums to 665 new passes and $5.2M.  The total achieved would be 92% of the original goal and 92% of the $10M would be paid out. $800,000 would revert to the federal government.  If they can do more passes then more $ could be paid out.

Yes, there are risks that from 1 to 665 passes will not be completed. There is also no other remedy.

The county will continue to apply for new programs like BEAD and others. The 518 addresses now cut and those that were in the "doughnut" areas are certainly disappointed and many are angry. I've attached a list of the 665 addresses to be covered in the amendment.

Sincerely,

Jamezetta Bedford, Chair

Dear Commissioners,

I noticed that on the agenda for your 16 June 2026 meeting, one item addresses that you will consider amending the 2022 agreement with Lumos to extend broadband service to an additional 105 households.

Where might those household be?

Thank you,
Robert

Dear Commissioners,

I write to thank Commissioners McKee and Hamilton for their votes on 16 Sept. 2025, to hold Lumos/T-Mobile, and to hold the county itself, to their commitments to bring to all of Orange County today's internet technology.  Regrettably, my area and other areas of the county are now forced to live on with "inadequate" (aka lousy) internet connections.  I know that the county hopes for future state funding, given the increasing fiscal pressure on the state, due to a number of factors, I place little stock in those hopes.

Most assuredly unhappy,
Robert Dalton

Ms. Bedford,

My initial reply to your message was emotional, I admit.  Now that I have settled a bit, let me add the following.

One.  I can understand houses that are "unserved" by the internet.  Please explain the difference between "underserved" and "inadequate" in regards to internet service.

Two.  That Lumos/T-Mobile has overspent, I accept.  But assuming they engaged in due diligence before taking on this project, they would have allowed for that risk.

Three, as I wrote before,T-Mobile has deep financial resources to complete the original plan, IF that company wants to be a positive corporate "person."

Four, that Bald Head Island off our coast has high speed internet cable, and we and other areas of Orange County, so close to Chapel Hill, Carrboro, and Hillsborough, don't, is a public shame.

The individual addresses included in the amendment are itemized on Attachment B3 to that agenda item.  I have copied over the addresses that are included on Maynard Farm Rd. below.

I have also copied the County’s CIO, Robert Reynolds, on this email if you have any specific questions about the proposed deployment.

Thank you for your email.

Mr. Myren,

Please accept this follow-up, though perhaps Mr. Reynolds might be the one to respond.

If I am understanding your message correctly, Lumos will be running fiber down our road.  Once that happens, how do individual property owners get their houses connected?  Thanks.

Robert
