1) For most of us BBA is not registered agreement. As neither we nor builder thaught to get it registered.
2) Land of law is supreme even though if signed agreement says otherwise.
3) Land of laws said any signed documents is Null and Void if it's one sided.
4) BBA is merely saying information regarding projects its not legal at all.
What we need to do to cater unreasonable demands of builder:
1) As of now several law exist majorly UP Apartment Act 2010 and RERA
2) Use following channels based on need (I suggest use most of it if not conflicts)
- Complain to dedicated official of authority as per RERA and UP Apartment Act
- CREDAI grivences cell
- complain it to online forums(legal) I already shared few links in past
- PM/CM Office portals
- Try to form a group on similar issues and take helps from other groups e.g. Nefowa
- Complain to law and enforcement agency and social media.
3) Go-to consumer forum (Economic Offence Wing) and other consumer forums
4) If required file a civil and criminal suites
Please note only expecting justice is waste of time and energy we need to do action as a individual and group level to get justice. If we keep eye shut for others issues or current issue then there are chances that when you face heat you will find no one who works with you or guide you.
