New Delhi, May 21st: The Convention titled "Sewer, Struggle and Livelihood: National Convention on Sewer Workers’ Issue" was held on 21st May, 2022.
The aim of the Convention was to bridge the gap between policy makers, implementation institutions, and employees. The Convention was attended by more than 250 sewer workers of the convention includes representatives from government bodies, organisations, trade unions, and legal background. All the sessions began with sewer workers sharing about their lives and struggles associated their work with the panelists. The workers shared that in addition to the exploitation by contractors, they also face casteism in the form of ‘untouchability’ when they go to work. Many workers faced the brunt of their hazardous jobs in their lives, few of them are permanently ill and are not in a position to even sustain themselves or their families.
The convention was spread in 4 sessions:
1. First Session: Struggle of Sewer / Septic Tanks Workers and their current conditions.
Panelists: Hemlata Kansotia- Convenor, National Campaign for Dignity and Rights of Sewerage and Allied Workers, Rajasthan, Radhika Bordia- Director India Programme, Missouri School of Journalism, USA, Sanghmitra Acharya- Professor, Jawaharlal Nehru University (JNU), Ved Prakash- President, Delhi Jal Board Sewer Department Mazdoor Sangathan, Virendar Gour- Municipal Workers Lal Jhanda Union and Satyam Srivastava- Co Director, SRUTI.
· The workers receive no safety equipment at work place.
· Majority of the workers come from Scheduled Caste / Dalit community.
· Money is deducted from their wage for non-working days such as Saturday, Sunday, and other public holidays.
· A strong demand for ending contractual system as it causes many problems linked to it.
· Despite risking their lives, there is complete uncertainty of the job. As a worker said “For breads we are forced to put our hands and at times our bodies in toilets and tanks, but nothing is provided to us by the government.”
2. 2nd Session: Role of Trade Unions on sewer / septic tank workers issues.
Panelists: Hannan Mollah- General Secretary, All India Kisan Sabha (AIKS), Com. Sucheta- All India Central Council of Trade Unions (AICCTU), Sukumar Damle- General Secretary, All India Trade Union Congress (AITUC) and Goutam Modi- General Secretary, New Trade Union Initiative (NTUI).
· The session was centered on the unionization of workers and the role that unions have played and will play in raising the sewer workers issues and demands.
· All unions collectively announced to eradicate caste systems and take up the matters of manual scavengers on their agenda and fight to free server /septic tank cleaners from the contractual system.It was said that due to the fear and uncertainty of livelihood, the workers have not been able to unite, and we are moving rather backwards. Since workers belong from a vulnerable class via caste and economically, their lives are considered less valuable than others, which in turn is one of the primary reason of the compensation of Rs. 10 lakh instead of making sure that no death takes place.
· The cleaning work is permanent but the one who does this work is temporary and no measures are currently under process which will make the sewer workers status as permanent employees. Despite risking their lives for years, don’t they deserve at least a permanent employee status?
· Questions were raised about the availability of sewer cleaning machines and why in 2022, the person has to go inside a sewer / septic tank or open drainage and clean it manually.
3. Third Session: Institutional and legislative perspectives towards sewer / septic tank workers.
Panelists: Sanjay Gahlot, Chairperson, Delhi Safai Karamchari Commission, Ajay Dutt- MLA, Ambedkar Nagar, Rohit Kumar- MLA, Trilokpuri and Umesh Babu, Sr. Economist & Adviser - DASAM
The panellist recognised that there are many families today who have lost their family members to the sewer.
All legislatures unanimously announced to support the implementation of Honb'le Court’s order "we will free sewer / septic tank workers from the clutches of the contractual system and ensure their permanent employment under government".
It was also observed by the panellists that budget of Delhi Government spent on contractor is enough to give permanent employment status to sewer / septic tank cleaners working under contractual system. In the Year 2018-19 Rs. 535 Cr, In the Year 2019-20 Rs. 523 Cr, in the Year 2020-21 Rs. 825 Cr were spent and in the Year 2021-22 Rs. 825 Cr is also likely to be spent on contractors.
Legislatures ensured to raise the issue in the assembly at the disposal of union leaders and other organizations of the Safai Karmachari.
They promised the sewer workers that adequate steps will be taken for the issues which were raised at the convention and will be raised in the Legislative Assembly.
4. Fourth Session: Status of Sewer / septic tank workers under judicial provisions.
Panelists: Arkaja Singh- Centre for Policy Research (CPR), C Adhikesavan- Advocate Supreme Court of India, Advocate Kawalpreet Kaur, Dharmendra Kumar- Secretary, Janpahal.
· Only when the deaths happen, the law comes in. The safety equipment is pseudo and there has been no testimony of that. Then, why do we keep talking about the safety equipments?
· This is also a problem of engineering design; the way sewers are made, they are like death chambers. Their basic science is faulty.
· We need to establish accountability. The responsibility should be taken by the government and outsourcing should be stopped.
· The Legal aspect should not become a limitation but rather should be used more.
· The question of the compensation is also kept flexible and very few are paid the full amount.
Immediate Demands which raise from the Convention:
1. Government should make direct recruitment of workers and regularize the works of sewer / septic tank and open drains. All the workers should get a mention in payroll / muster roll by the concerned departments of the government with restrospective dates.
2. The process of outsourcing sewer / septic tank / open drains cleaning work from private contractors should be restrained from immediate effect.
3. In case of sewer worker's injury, treatment should be done under Employees' State Insurance Fund till complete recovery.
4. Hiring authority or person should be held responsible in case of any accident and should be convicted under law.
5. Rehabilitation of sewer / septic tank / open drain workers and better education and employment for their children should be guaranteed.

सीवर कर्मचारियों के मुद्दे पर राष्ट्रीय सम्मेलन

"अपनी रोटी के लिए हम मजबूर होकर हाथ और शरीर को शौचालयों और सेप्टिक टैंक में डालने को मजबूर हैं, लेकिन सरकार हमें कुछ भी नहीं देती है ।"

नई दिल्ली, 21 मई: "सीवर, संघर्ष और आजीविका: सीवर कर्मचारियों के मुद्दे पर राष्ट्रीय सम्मेलन" मुद्दे पर 21 मई, 2022 को कॉन्स्टीट्यूशन क्लब में एक सम्मलेन आयोजित किया गया ।
कन्वेंशन का उद्देश्य नीति निर्माताओं, क्रियान्वयन संस्थानों और कर्मचारियों के बीच की खाई को पाटना था । कन्वेंशन में 250-300 सीवर कर्मचारियों ने भाग लिया, जिसमें सरकारी संस्थानों, संगठनों, ट्रेड यूनियनों और कानूनी पृष्ठभूमि के प्रतिनिधि शामिल हैं ।
सभी सत्रों की शुरुआत में सीवरकर्मचारियों ने पैनलिस्टों के साथ अपने काम, जीवन-यापन और संघर्षों की दास्तान साझा किया । कर्मचारियों ने बताया कि ठेकेदारों द्वारा शोषण के अलावा, जब वे काम पर जाते हैं तो उन्हें जातिवाद और 'अस्पृश्यता' का भी सामना करना पड़ता है; यहाँ तक कि प्यास लगने कोई पानी भी नहीं पिलाता है । कई कामगारों को अपने जीवन में खतरनाक परिस्थितियों का सामना करना पड़ा, जिनमें कुछ के परिवार के सदस्य दिवंगत हो चुके हैं, कुछ स्थायी रूप से बीमार हैं जिससे कि वे खुद का और परिवार का भरण-पोषण करने की स्थिति में भी नहीं हैं ।
सम्मलेन का विस्तार चार स्तरों में था:
1. पहला सत्र: सीवर / सेप्टिक टैंक श्रमिकों का संघर्ष और उनकी वर्तमान स्थिति ।
पैनलिस्ट: हेमलता कंसोटिया- संयोजक, राष्ट्रीय गरिमा और सीवरेज और संबद्ध श्रमिकों के अधिकारों के लिए अभियान, राजस्थान, राधिका बोर्डिया- निदेशक, भारत कार्यक्रम, मिसौरी स्कूल ऑफ जर्नलिज्म, यूएसए, संघमित्रा आचार्य- प्रोफेसर, जवाहरलाल नेहरू विश्वविद्यालय (जेएनयू), वेद प्रकाश- अध्यक्ष, दिल्ली जल बोर्ड, सीवर डिपार्टमेंट मजदूर संगठन, वीरेंद्र गौड़ – म्युनिसिपल वर्कर्स लाल झंडा यूनियन (CITU) और सत्यम श्रीवास्तव- सह निदेशक, श्रुति ।
· कामगारों को कार्यस्थल पर कोई सुरक्षा उपकरण नहीं मिलता है ।
· अधिकांश कर्मचारी अनुसूचित जाति / दलित समुदाय से आते हैं ।
· छुट्टी के दिनों जैसे शनिवार, रविवार और अन्य सार्वजनिक छुट्टियों के लिए उनकी मज़दूरी का पैसा काट लिया जाता है ।
· ठेकेदारी प्रणाली को समाप्त करने की जोरदार मांग की गयी क्योंकि इससे जुड़ी कई समस्याएं पैदा होती हैं ।
· अपनी जान जोखिम में डालने के बावजूद आजीविका को लेकर पूरी तरह अनिश्चितता बनी रहती है । जैसा कि एक कर्मचारी ने कहा "अपनी रोटी के लिए हम मजबूर होकर हाथ और शरीर को शौचालयों और सेप्टिक टैंक में डालने को मजबूर हैं, लेकिन सरकार हमें कुछ भी नहीं देती है ।"
2. दूसरा सत्र: सीवर/सेप्टिक टैंक कर्मचारियों के मुद्दों पर ट्रेड यूनियनों की भूमिका ।
पैनलिस्ट: हन्नान मोल्ला, महासचिव, अखिल भारतीय किसान सभा (AIKS), कामरेड सुचेता डे, ऑल इंडिया सेंट्रल काउंसिल ऑफ ट्रेड यूनियन्स (AICCTU), सुकुमार दामले- महासचिव, ऑल इंडिया ट्रेड यूनियन कांग्रेस (AITUC) और गौतम मोदी- महासचिव, न्यू ट्रेड यूनियन इनिशिएटिव (NTUI) ।
· यह सत्र, कर्मचारियों के यूनियन के तहत एकीकरण और सीवर कर्मचारियों के मुद्दों और मांगों को उठाने में यूनियनों की भूमिका पर केंद्रित था ।
· सभी यूनियनों ने सामूहिक रूप से जातिगत व्यवस्था को मिटाने और हाथ से मैला उठाने वालों के मामलों को अपने एजेंडे में लेने और सीवर / सेप्टिक टैंक क्लीनर को ठेकेदारी प्रणाली से मुक्त करने के लिए संघर्ष करने की घोषणा की ।
· कर्मचारियों की बातें सुनकर यह स्पष्टता से स्वीकार किया गया कि रोजी-रोटी के डर और मजदूरी की अनिश्चितता के कारण मजदूर एकजुट नहीं हो पाए हैं | इस स्थिति से साफ है कि यूनियन के तौर हम आगे नहीं बल्कि पीछे की ओर बढ़ रहे हैं |
· चूंकि सीवर / सेप्टिक टैंक कर्मचारी जातिगत भेदभाव और आर्थिक रूप से कमजोर वर्ग से संबंधित हैं, इसलिए उनके जीवन को दूसरों की तुलना में कम मूल्यवान माना जाता है | जिसके कारण जान के बदले में मामूली 10 लाख रूपये का मुवाजा दिया जाता है बजाय उनको स्थायी नौकरी देने और बेमौत घटनाओं को रोकने की |
· सफाई का काम स्थायी है लेकिन जो यह काम करता है वह अस्थायी है और वर्तमान में कोई उपाय प्रक्रियाधीन नहीं है जो सीवर कर्मचारियों को स्थायी कर्मचारी का दर्जा दिला सके । यह सवाल उठा कि - वर्षों तक अपनी जान जोखिम में डालने के बावजूद, क्या वे कम से कम एक स्थायी कर्मचारी की स्थिति के लायक भी नहीं हैं?
· सीवर सफाई के मामले में मशीनों की उपलब्धता के बारे में सवाल उठाए गए और 2022 में व्यक्ति को सीवर/सेप्टिक टैंक या खुले जल निकासी के अंदर क्यों जाना पड़ता है और इसे मैन्युअल रूप से साफ करना पड़ता है ।
3. तीसरा सत्र: सीवर/सेप्टिक टैंक कर्मचारियों के प्रति संस्थागत और विधायी दृष्टिकोण ।
पैनलिस्ट: संजय गहलोत, अध्यक्ष, दिल्ली सफाई कर्मचारी आयोग, अजय दत्त- विधायक, अंबेडकर नगर, रोहित कुमार- विधायक, त्रिलोकपुरी और उमेश बाबू, वरिष्ठ अर्थशास्त्री और सलाहकार - दसम
· पैनलिस्ट ने माना कि आज दिल्ली में कई परिवार ऐसे हैं जिन्होंने अपने परिवार के सदस्यों को सीवर में खो दिया है ।
· सभी विधायकों ने सर्वसम्मति से माननीय न्यायालय के आदेश के क्रियान्वयन का समर्थन किया और यह वादा किया कि "हम सीवर / सेप्टिक टैंक कर्मचारियों को अनुबंध प्रणाली के चंगुल से मुक्त करेंगे और सरकार के तहत उनका स्थायी रोजगार सुनिश्चित करेंगे" ।
· सभी विधायकों सीवर कर्मियों से वादा किया कि अधिवेशन में उठाए गए मुद्दों को विधानसभा में उठाए जाने के लिए पर्याप्त कदम उठाए जाएंगे ।
· पैनलिस्टों द्वारा यह भी देखा गया कि ठेकेदार पर खर्च की गई दिल्ली सरकार का बजट ठेकेदारी प्रणाली के तहत काम करने वाले सीवर / सेटिक टैंक क्लीनर को स्थायी रोजगार देने के लिए पर्याप्त है । वर्ष 2018-19 में रु 535 करोड़, वर्ष 2019-20 में रु 523 करोड़, वर्ष 2020-21 में रु 825 करोड़ खर्च किए गए और वर्ष 2021-22 में भी रु 825 करोड़ ठेकेदारों पर भी खर्च होने की संभावना थी ।
· विधायकों ने यूनियन के नेताओं और सफाई कर्मचारी के अन्य संगठनों के निष्पादन पर विधानसभा में इस मुद्दे को उठाना सुनिश्चित किया, वे विभिन्न विधायी समितियों के सदस्य भी हैं और उनमें भी इस मुद्दे को उठायेगें |
4. चौथा सत्र: न्यायिक प्रावधानों के तहत सीवर / सेप्टिक टैंक कर्मचारियों की स्थिति ।
पैनलिस्ट: अरकाजा सिंह- सेंटर फॉर पॉलिसी रिसर्च (सीपीआर), सी अधिकेशवन- एडवोकेट सुप्रीम कोर्ट ऑफ इंडिया, एडवोकेट कवलप्रीत कौर, धर्मेंद्र कुमार- सचिव, जनपहल ।
· कानून केवल घटना होने यानि मौत के बाद आता है । सुरक्षा उपकरण एक धोखा है और इसके लागू होने का कोई प्रमाण नहीं है । फिर, हम सुरक्षा उपकरणों के बारे में बात क्यों करते रहते हैं?
· यह भी इंजीनियरिंग डिजाइन की समस्या है; जिस प्रकार सीवर बनाए जाते हैं, वे मौत के चैम्बर के समान होते हैं । उनका मूल विज्ञान ही दोषपूर्ण है ।
· हमें जवाबदेही तय करने की जरूरत है । सरकार को जिम्मेदारी लेनी चाहिए और आउटसोर्सिंग को रोकना चाहिए ।
· कानूनी पक्ष एक सीमा के तहत सिमित नहीं होना चाहिए बल्कि इसे व्यापक अर्थों में न्याय के दृष्टिकोण किया जाना चाहिए जिसका विस्तार सामाजिकता और आर्थिक भी है ।
· मुआवज़े की शर्तों में ऐसे पेंच हैं जिससे पीड़ित लोगों में से बहुत कम लोगों को पूरी रकम का भुगतान किया जाता है ।
कन्वेंशन से उठी तात्कालिक मांगें:
1. सरकार कर्मचारियों की सीधी भर्ती करे और सीवर/सेप्टिक टैंक और खुले नालों के कार्यों को नियमित करे । सभी कर्मचारियों को सरकार के संबंधित विभागों द्वारा जबसे काम कर रहे हैं उन तिथियों से पेरोल / मस्टर रोल पर उल्लेखित करें ।
2. निजी ठेकेदारों से सीवर / सेप्टिक टैंक / खुली नालियों की सफाई कार्य की प्रक्रिया को तत्काल प्रभाव से रोका जाए ।
3. सीवर कर्मी के घायल होने की स्थिति में पूर्ण रूप से स्वस्थ्य होने तक कर्मचारी राज्य बीमा कोष के तहत उनका उपचार किया जाना सुनिश्चित किया जाय ।
4. किसी भी दुर्घटना के मामले में काम कराने वाली अथॉरिटी या व्यक्ति को जिम्मेदार ठहराया जाना चाहिए और कानून के तहत दोषी ठहराया जाना चाहिए ।
5. सीवर / सेप्टिक टैंक / ओपन ड्रेन कर्मचारियों का पुनर्वास और उनके बच्चों के लिए बेहतर शिक्षा और रोजगार की गारंटी दी जानी चाहिए ।
