"Eric Fried, Larimer County’s Chief Building Officer, testified that the rock wall is un-permitted"
"Mr. Fried testified that, unless an engineer certifies the rock wall, Defendant (Michael Kennedy owner of 689 Pine Tree Drive) will need to remove the rock wall within 90 days of the issuance of a building permit."
"The Court finds that the rock wall is not
permitted and that Larimer County requires Defendant to remove the rock wall and
restore the driveway to its pre-wall condition within 90 days of the issuance of a
building permit."
However, the County did not intend for the rock wall to be a long-term (~3 yr.) structure. It is not known if or when the Defendant will be issued a building permit. And, the property where this wall is built is not on the Defendant's property, it is on the right of way of Pine Tree Drive, which is to be maintained by the MHOA/GID of Larimer County.
Furthermore, this rock wall continues to deteriorate, receding from its original height, taking on a concave position with boulders occasionally falling downhill and dirt washing over it with every rain and snow melt. If you should have adverse impacts from this wall, I would contact the MHOA and Larimer County Chief Building Officer Eric Fried.
