I am looking for anyone that can tell me where to start looking for
some legal information.
I am a divorced father of two and I have recently won the custody
battle where my ex-wife now only has our children every other weekend.
I have recently re-married and my children are very happy we have.
They love her very very much. My ex-wife on the other hand is doing
everything she can to try and keep my wife from being in the
children's lives, even though the children live with us the majority
of the time.
I recently came across an article , here is the link.
http://www.divorcenet.com/states/new_hampshire/nhart_05
The part of the article i am most interested in is this "In the case
of In re Shelby R., 148 N.H. 237 (2002) the New Hampshire Supreme
Court held "As stepparents have a significant private interest in
preserving and protecting family life, we conclude they are entitled
to protection under Part I, Article 15 of the State Constitution. Our
view is consistent with the fact that stepparents are a commonplace
presence in the nuclear family and that the New Hampshire Legislature
and Judiciary have consistently expanded the rights and duties of
stepparents." Bodwell v. Brooks, 141 N.H. 508, (1996). Additionally,
stepparents who demonstrate a full commitment to raising and caring
for their stepchildren are generally charged with the rights and
duties attributed to natural parents. See id. at 513."
I live in NH so what I need to know is
1: Where I can find what these rights are that NH has given to
stepparents
2: How i can prove "a full commitment to raising and caring for their
stepchildren"
Any help or direction would be appreciated.
