Sheweth: Brief…Petition to suggest reduction in Water Pollution.
Like air, the water pollution in the country has also reached alarming levels. At many places the contamination level in ground water tables is extremely high rendering it unfit human consumption. One of the major reasons of water pollution is the high level of toxins mixed in water. Such water full of toxins ultimately finds its way into rivers or is mixed into ground water. Besides release of water into river system, there is no control over absorption of such water by ground leading to contamination of water reserves having serious implications. In addition to industrial effluents a huge chunk of such chemicals is a result of increased use of cleaning substances at every residence & office for washing clothes, utensils, floor, toilet, self-body etc. All such materials i.e. soaps, shampoos, detergents, phenyls, toilet cleaners or other liquid/solid cleaners, contains high degree of chemical contents ultimately going into rivers through drain. The day when we will be able to treat all the effluent flowing through drains before it finally tumbles into rives is far in future, and we need to do something for that.
Given that India has huge population just for bathing several hundred ton of soaps must be flowing daily into drains. Rest of the items, like clothes, utensils, toils are extra making it a mammoth damage. Though there are some regulations dealing with release of effluents by industry but there is no law which regulates the release of chemical infested water by houses & offices into drainage system.
Therefore, there is need to take steps to control this large scale damage immediately.
And accordingly your petitioner pray that -
(i) The matter may be taken up with a scientific body to develop or promote such cleaning substances with low or no chemical contents which can lead to less pollution in rivers. Lesser detergent contents may also provide more chances for biological life to maintain itself within drains. An immediate analysis of all the cleaning substances available in market may be done and detergents/soaps containing high level of harmful chemicals may be considered for ban along with a public awareness campaign.
(ii) In addition, as a strategic step, it is suggested that a law be framed to regulate the chemical composition of various cleaning material meant for day-to-day use in houses & offices. The law should describe the upper limits of polluting chemicals which can be used in per unit of such cleaning material. Such a regulation shall immediately help in curbing the water pollution across country. This will also reduce the work load on sewage treatment plants and bring ease in re-cycling water.

Ref (i): No. SKG/RS/018 dated 30 May 2017.
Ref (ii) No. RS.7(42)/2017-Com.II dated 10/08/2017 and
Ref (iii) No. RS.7(42)/2017-Com.II dated 23/08/2017.
A petition was submitted [wide reference (i) above] to Rajya Sabha regarding excessive pollution of water resources due to heavy usage of highly chemical infested cleaning substances used on day to day basis in all the homes & offices for cleaning floor, toilet, dishes, clothes, vehicles, hairs, body etc. It was suggested that rules be frames to control the chemical contents in all such material so that less polluted water is discharged in rivers and earth bed. In response the petition was transferred for examination by M/o Environment, Forest & Climate Change (MoEFCC).
In response, wide reference (ii) above remarks of MoEFCC were provided. Ministry accepted that at present there are standards only to regulate discharge of industrial effluents, sewage of any polluting matter into stream/sewer. It implies that there are no law to control discharge of such effluent water by house-holds & offices. The Ministry also stated that developing such standards is within the purview of Bureau of Indian Standards (BIS) under M/o Consumer Affairs, Food & Public Distribution (M/o CAFPD).
Later, wide above reference (iii) comments of M/o CAFPD were provided which stated that existing Indian standards on soaps & detergents prescribes the chemical and additive as per the prevailing Drugs & Cosmetic Rules which are not mandatory for industry to follow. The response also mentioned that imposing ban on presently available cleaning substances in the market in view of their containing high levels of harmful chemical is not in the purview of BIS. Another important point reply contained was to specify that matter should be referred to Drugs & Cosmetic Regulatory Authority. It also advised that consultation is required with different stakeholders as well as regulatory authority.
All the above deliberation and transfer of inter ministry petition confirms that the issue raised under petition is valid and at present it is on no one’s radar to check such pollution. It is obvious that all the 3 authorities referred i.e.
M/o Environment, Forest & Climate Change,
M/o Consumer Affairs, Food & Public Distribution and
Drugs Controller General of India.
will have their own point of view on the issue. It is surprising that despite matter being directly connected with the heavy water pollution M/o EFCC almost showed no concern and stated that matter does not fall within their purview?
The function so Central Pollution Control Board (CPCB), which is a statutory body under M/o EFCC, includes:
Advise the Central Government on any matter concerning prevention and control of water and air pollution and improvement of the quality of air.
Plan and cause to be executed a nation-wide program for the prevention, control or abatement of water and air pollution;
On the face of it, it is not understood that as to why instead of directing its own wing i.e. CPCB to take measures to formulate standards case was referred to BIS.
Likewise, BIS also clearly stated that standards made by it are voluntary in nature and for making water discharge standards case be referred not only to Drugs Controller General of India but also discussed with other stake holders.
It appears that, for the time being, matter has been put to a spin where near future solution is difficult because of involvement of multiple authorities and perspectives.
As the matter is extremely important & urgent due to ever rising water pollution, the issue should not be dragged for long.
It is, therefore, requested that a meeting of all stakeholders be convened by Rajya Sabha secretariat for discussion and taking concrete time bound action plan.
