When FSSAI introduced the provision of placing red mark on sweet boxes using chandi ka wark which has been prepared as per traditional methods containing animal traces, the regulation was vigorously opposed by the association of manufacturing units. As a result, the order faced legal challenges and was stayed for a long time before being finally vacated on 23/01/2018 by Delhi High Court under WPC No. 6413/2017. Now more than 4 years have passed since this enactment but the there is no enforcement of the same.

 

Similarly, under Food Safety and Standards (Prohibition and Restriction on Sales) Regulations, 2011

selling fruits artificially ripen with the help of harmful & banned chemicals Calcium Carbide

is also prohibited and despite the fact that each & every shop is violating this provision there is no conviction.

 

Recently, we filed an RTI to know the status of enforcement status of above legislation and in response Department of Food Safety, GNCT (letter reference number 240/RTI/FS/2022/2166/07072022) informed that there is no information available for any such case being detected.

 

This is no less than broad daylight murder of the legal provisions. When every nook and corner is indulged in this crime the department is sleeping.

 

Although misleading people to consume non-vegetarian items is against the ethics and letting people consume fruits ripen with the help of chemicals is hazardous, the department has not shown any activity to curb this.

 

In view of this it is requested that:

 

(1)   Department be directed to take instant action to curb such gross violations and

(2)   Responsibility be fixed for hitherto non-enforcement of these legal provisions.
