In the matter of Mr. Duc Huy NGUYEN vs. Dr. David Hiep PHAN of Broadmeadows (‘Dr. PHAN’)
This is the third time Dr. Phan has initiated legal proceedings against me. On each occasion, he has made false statements in his applications for an interim intervention order, using the court to attempt to silence my concerns regarding his and his family's unlawful activities. I have gathered sufficient evidence to support my claims, and I firmly believe that if Dr. Phan is found guilty, he should be sentenced to two years in prison. As far as I know, under Victorian law, individuals who make false statements in legal proceedings with the intent to harm others can face up to two years in prison, and Dr. Phan should be held accountable.
I have only one witness, Mr. Roger Anh NGUYEN, whom I mentioned in my earlier statement. He told me that he worked with Dr. PHAN during the COVID-19 pandemic in 2020. While working with him, Dr. PHAN allegedly told Roger that he would use his money to silence me and prevent me from speaking about Dr. PHAN and his family's illegal activities. Please note that Dr. PHAN is a millionaire, and I am concerned that he may resort to hiring an assassin to silence me, which causes me great concern. I have reported this matter to the Victoria Police.
Upon reviewing the evidence presented by Dr. Phan against me, I have found it to be inaccurate and misleading, with clear signs of intentional falsification. Furthermore, the testimony provided by Dr. Phan’s witnesses is similarly flawed and unreliable.
I'm not sure if there are any prison penalties for a witness who intentionally gives false testimony to harm others. If a witness simply provides reckless testimony that causes harm, it would be an injustice to the person affected. I heard that under the state law in Victoria, a person who gives false testimony could face up to 5 years in prison, but I'm not sure if that's accurate

STATEMENT OF MATERIAL FACTS in the matter of Mr Duc Huy NGUYEN vs. Doctor David Hiep PHAN of Broadmeadows (‘Dr PHAN’)

I always wanted to have mediation with Dr. PHAN. I sent him multiple letters asking if we could hold one to resolve our issue, but I don’t know why he never wanted to.

I believe Dr. PHAN and his solicitor made false statements in their application for the issuance of an interim intervention order, intending to use the Court to prevent me from speaking about Dr. PHAN and his family’s law violations.

In September 2024, I discovered and reported to the parish priest that Dr. Phan and his organization were unlawfully using the logo of St. Paul of West Sunshine Parish to promote unauthorized events. The parish priest subsequently ordered Dr. Phan and his organization to remove the logo due to copyright infringement. I have evidence to present in court, and I believe this is why Dr. Phan is taking legal action against me.

In his application, Dr. Phan falsely claimed that I was his friend or former friend. He is the president of a Vietnamese community organization in Australia, and he is either a politician or aspires to be one, while I am just a common man. We are not friends at all, and I have never met Dr. Phan or his family in person.

I texted Dr PHAN and advised him of my knowledge regarding his family organising a fake wedding to bring PHAN's younger brother to Australia. As soon as I finished texting, Dr. PHAN called me at 5 minutes to midnight. He trembled and begged me not to say it to the public, but now Dr PHAN turned around and took me to court.

After I sent Dr. Phan a message informing him that I had received information about him and his family allegedly organizing a sham marriage to bring someone into Australia, Dr. Phan retaliated against me by:

He published numerous personal details about me on a Facebook account, including private and medical information concerning my parents and siblings, which he obtained as their GP. He disclosed information about my parents’ mobility struggles, who brought them to appointments and criticized me for not taking them to see him. Doctor-patient confidentiality prohibits him from making his clients' medical details public.

The fact that Dr. PHAN's younger brother allegedly entered Australia through a sham marriage is widely known within the Vietnamese community near Dr. PHAN's medical clinic. If the Presiding Judge wishes to investigate, a simple interview with Dr. Hai PHAN of Footscray, Dr. Anthony Thanh PHAN of Craigieburn, Dr. David Hiep Dinh PHAN of Broadmeadows, and their family members (including parents, siblings, and in-laws) could easily uncover the truth.

Furthermore, Dr. PHAN slandered me by falsely accusing me of being a pedophile and alleging that I sexually harassed clients and molested young girls, including clients' children.

Dr. PHAN also falsely claimed that I had sexually harassed young girls at a church in Sydney and that I wanted to sleep with those girls at the church.

Dr. PHAN often referred to me as “destitute,” “a mad dog,” “illiterate,” “stupid,” and “uneducated.” However, I firmly believe that I am a good person, a responsible citizen, and a person of dignity.

I respectfully request that Dr. PHAN issue a broad public statement clearly explaining the acts of libel, defamation of honor and dignity, and false allegations of pedophilia, indecent conduct (in inappropriate places), and sexual harassment, among others, to resolve this matter.

After I sent Dr. Phan a message informing him that I received information about him and his family organizing a fake wedding to bring someone into Australia, Dr. Phan retaliated against me by:

Publishing on Facebook account lots of my personal matters (concerning my parents and my siblings, including their private and medical details which he obtained as their GP). He exposed how my parents struggled with mobility, who took them to see him as the doctor, and criticized that I never took my parents to medical appointments, etc., and other things about them as patients which a doctor should not be allowed to tell others.

The fact that Dr. PHAN's younger brother entered Australia through a fake marriage is known by many people in the Vietnamese community residing near Dr. PHAN's surgery. If the Presiding Judge needs to conduct an investigation, a simple interview with Dr. Hai PHAN of Footscray, Dr. Anthony Thanh PHAN of Craigieburn, Dr David Hiep Dinh PHAN of Broadmeadows and their family (including parents, siblings, and in-laws) would easily uncover the truth.

Furthermore, Dr PHAN slandered me of being a paedophile, accusing me of sexually harassing clients, and molesting little girls, and children of clients.

Dr PHAN also made up that in 2018 I had sexually harassed young girls at a church in Sydney and that I wanted to sleep with those girls at the church...

Dr. PHAN always cursed me as “being destitute”, “a mad dog”, “being illiterate”, “being stupid” and “being uneducated”, but I strongly believe that I am a good person, a good citizen, and a dignified person.

On 29/07/2023, 17/07/2022, and 29/09/2021 between 9:00 PM and 10:00 PM, for no reason, Dr PHAN abused and defamed me and made the threats via live streams on Facebook. During the podcast, Dr PHAN cursed me very badly. Dr PHAN disclosed all my details such as my name, my business name, and my address. His deed is unethical and unacceptable as it breached the privacy acts. I have recorded his live stream videos to testify in court.

Dr. Phan has made serious threats against me twice in court. At the second hearing on 29/09/2021, the Presiding Judge asked Dr. Phan and his solicitor if they had any evidence against me, and because they could not provide any evidence, the Presiding Judge then ordered both parties to participate in mediation with a professional mediator. Before I left the courtroom, Dr. Phan said to me TWICE: "You are old but you are still stupid. You will be dead!” This led to angry exchanges between Dr. Phan and me. As a result, the Presiding Judge had asked both parties to leave the courtroom. Dr. Phan could not control his behaviors in public, let alone in his public live-stream podcasts, where he is in control and is free to accuse and intimidate me at his own will. In case Dr. Phan denies the threat, the Presiding Judge can watch and listen again to the audio, and video recorded (court's CCTV cameras) right after the trial on September 29, 2021, (Melbourne’s Court ref: M10579865).

At that time, Dr PHAN was granted an interim intervention order that restricted me from talking about or referring Dr. PHAN on social media. Dr PHAN knows I am restricted in that I am unable to talk about Dr. PHAN or refer to Dr PHAN on Facebook as part of an interim intervention order, then Dr PHAN kept challenging me many times if I dared to say his name and address like Dr PHAN did to me. This provokes me to reply in order to breach the order.

Dr. Phan and his wife (Facebook Mai Pham - I think Dr. Phan has used his wife's Facebook) have been repeatedly commenting on my Facebook in an attempt to provoke me. This provokes me to reply and potentially violate the court order. I have reported this issue to the Fawkner police station. Dr. Phan has also made numerous derogatory/abusive and offensive comments towards me on his Facebook and on other people's Facebook posts.

Dr PHAN is the President of the Vietnamese Community in Australia and Dr PHAN is also the President of the Australian Vietnamese Health Professionals Association in Australia so many people listened and shared his video; it’s making me worried and affecting my mental health in a negative manner. Dr PHAN is a well-known person in the Vietnamese community in Australia and outside of Australia. His reputation, with the fact that so many people listen to and share his public live stream makes me worried. I have recorded his live stream videos to testify in court.

I seriously fear for my safety. I am old and lonely in my life. I live by myself and do not wish my personal information to be disclosed to the public without my permission. Especially through a public Facebook live stream where everyone can assess to the information. I am devastated.

I am an elderly member of the general community, and I seek help and support to protect us. In our time, we are vulnerable and we cannot face harmful situations, as I am now. I am seriously concerned about my safety and strongly feel abused and disrespected by Dr PHAN.

I have reported my complaint to the Department of Health and Human Services Victoria, the Victoria Police Department and the Australian Health Practitioner Regulation Agency complaining about the ethical conduct and mental and psychological health of Dr PHAN (Please read the following documents)

At the last hearing on 24/01/2023, I reported to the Presiding Judge that I have A VERY IMPORTANT WITNESS, whom is prepared to support me in this case but I did not know how to invite him to Court. At that point, the Presiding Judge asked me what I thought he would say if he was in court. I answered the Presiding Judge and the Presiding Judge has asked me to just write it down and add it to my statement for the upcoming hearing.

4.    I have contacted Roger. Roger stated that he worked with Dr PHAN during COVID-19 in 2020. When Roger was working with him, Dr PHAN asked Roger to create fake Facebook accounts and requested Roger to use those clone accounts to do illegal things to boost Dr PHAN’s reputation. Dr PHAN is the President of the Australian Vietnamese Health Professionals Association in Victoria. Dr PHAN is also the President of a Vietnamese community in Australia. Roger disclosed all that information on his Facebook live streams after he stopped working for Dr PHAN. Dr PHAN then blackmailed Roger and threatened to sue Roger if he fought back. That is why Roger is afraid to appear as a witness in court. He is fearful that Dr PHAN will take revenge on him. Roger's live videos which I mentioned above remain on his Facebook for testifying in court and I also have recorded his live stream videos to testify in court

1.                    My full name is Duc Huy NGUYEN. I am currently residing at Unit 1/82 Augustine TCE, Glenroy VIC 3046. I wish to present this statement of material facts for the consideration of the Court. The statement pertains to a matter between Dr David Hiep PHAN of Broadmeadows (‘Dr PHAN’) and me.

2.                    On 19/05/2022, I sent Dr PHAN a letter asking him how if we could have a mediation to resolve our issue, but I do not understand why Dr PHAN took me to Court. I always wanted to have a meditation with Dr. PHAN but I do not know why Dr. PHAN never wants to. I believe Dr PHAN and his solicitor made false statements in their application for the issuance of an interim intervention order and wanted to use the Court to silence me from talking about Dr PHAN and his family’s illegal activities

3.                    On 17/07/2022, between 9:00 PM and 10:00 PM, for no reason, Dr PHAN and Mr Quan DO (Solicitor) defamed me. They disclosed all my personal information to the public without my consent, via a public livestream on their Facebook channel. They were using abusive and disrespectful language directed at me which negatively affected my mental health. During the podcast, Dr PHAN and Mr Quan DO cursed me very badly; they disclosed all my details such as my name and business. Their deeds are unethical and unacceptable as it breached the privacy acts. Dr PHAN and Mr Quan DO are well-known persons in the Vietnamese community in Australia and outside of Australia. Their reputations, coupled with the fact that so many people listen and share the public live stream make me worried. I seriously fear for my safety. I am old and lonely in my life. I live by myself. I am devastated. I have recorded their live stream videos to testify in court

4.                    Dr PHAN is the President of the Australian Vietnamese Health Professionals Association in Australia. Dr PHAN is also a President of the Vietnamese community in Australia. Dr PHAN is now a politician or at least he wants to become a politician

5.                    On November 2021, Ms Roxanne MARTIN, a dispute assessment officer from the Department of Justice and Community Safety contacted me and as a result, I agreed to mediation with Dr PHAN as part of a Judge’s order. However, it appeared that Dr PHAN did not want to participate and as a result, the case was listed for a rehearing on 04/02/2022 (Melbourne’s Court ref: M10579865)

6.                    The third court appearance on 04/02/2022 was adjourned to 13/05/2022 by Dr PHAN’s solicitor so they can look for evidence against me (Melbourne’s Court ref: M10579865)

7.                    At the fourth hearing on 13/05/2022, the Presiding Judge denied Dr PHAN’s AVO application because he and his solicitor could not provide any evidence against me (Melbourne’s Court ref: M10579865)

8. Dr PHAN shouted “MEDIATION” several times in a loud voice with disapproval and contempt for the Judge’s order. Dr PHAN disclosed all my details such as my name, my business name, and my address. At this time, Dr PHAN was granted an intervention order that restricted me to talk about or refer Dr PHAN on social media. Dr PHAN knows I am restricted in that I am unable to talk about Dr PHAN or refer to Dr PHAN on Facebook as part of an interim intervention order, then Dr PHAN kept challenging me many times if I dared to say his name and address like Dr PHAN did to me. This provokes me to reply to breach the order. Dr PHAN is the President of the Vietnamese Community in Australia so many people listen and share his video; it’s making me really worried and affected my mental health in a negative manner. I have recorded his live stream videos to testify in court.

11.                 I have reported my complaint to the Department of Health and Human Services Victoria, the Victoria Police Department, and the Australian Health Practitioner Regulation Agency complaining about the ethical conduct and mental and psychological health of Dr PHAN.

12.                 In previous court appearances, the Presiding Judges advised me that I should have a lawyer to represent me in Court, but to be honest; I cannot afford a lawyer’s fee.

13.                 I believe Dr PHAN did wrong things to me. Dr PHAN always cursed me as “being destitute”, “a mad dog”, “being illiterate”, “being stupid” and “being uneducated”, but I strongly believe that I am a good person, a good citizen, and a dignified person, and I am not afraid to stand up to him or to defend myself when being deliberately vilified.

14.                 I believe Dr PHAN was involved in the fraudulent activity of organising fake marriages to bring people to Australia. Dr PHAN was aware of the illegality and not reporting to the relevant authority, he is clearly guilty of coercion, accomplice, or concealment of a crime, etc.

15.                 In early 2019, I texted Dr PHAN and advised him of my knowledge regarding his family organising a fake wedding to bring PHAN'S younger brother to Australia. As soon as I finished texting, Dr PHAN called me 5 minutes before midnight. He trembled and begged me not to say it to the public, but now Dr PHAN turned around and took me to court.

16.                 Dr PHAN always threatened to take people to court. I suspect that because he is a millionaire and he can hire or pay for a solicitor easily. I don't want to give in to Dr PHAN

Dr PHAN and his parents and his older brother Dr Hai PHAN of Footscray have deliberately deceived and intentionally tipped the scale of justice by defrauding Australian immigration law. They have conspired to bring Dr PHAN’s younger brother (Anthony PHAN) to Australia under a false pretense.

18.                 People have told me to let this matter go and I am prepared to do so, but I just could not fathom whether this egotistical doctor is mad, why he sued me in court. What a strange thing to do! I believe that Dr PHAN just wanted to use the Court to silence me from talking about his illegal activities

He exposed how my parents struggled with mobility, who took them to see him as the doctor, and criticized that I never took my parents to medical appointments, etc. and other things about them as patients which a doctor should not be allowed to tell others.

21.                 Furthermore, Dr PHAN slandered me of being a paedophile, accusing me of sexually harassing clients, and molesting little girls, and children of clients.

22.                 Dr PHAN also made up that in 2018 I had sexually harassed young girls at a church in Sydney and that I wanted to sleep with those girls at the church...

23.                 Dr PHAN always cursed me as “being destitute”, “a mad dog”, “being illiterate”, “being stupid” and “being uneducated”, but I strongly believe that I am a good person, a good citizen, and a dignified person and I am not afraid to confront if people deliberately provoked me.

24.                 The fact that Dr. PHAN's younger brother entered Australia through a fake marriage is known by many people in the Vietnamese community residing near Dr. PHAN's surgery. If the Presiding Judge needs to conduct an investigation, a simple interview with Dr. Hai PHAN of Footscray, Dr. Anthony Thanh PHAN of Craigieburn, Dr David Hiep Dinh PHAN of Broadmeadows and their family (including parents, siblings, and in-laws) would easily uncover the truth.

25.                 I would like Dr PHAN to issue a broad PUBLIC STATEMENT clearly explaining the ACTS OF LIBEL, DEFAMATION OF HONOUR AND DIGNITY & FALSE ALLEGATION of paedophilia, indecent copulation (at an inappropriate place) sexual harassment, etc. to end this matter
