Hi Helen,

Got this in the post yesterday, I note that they have not included Disabled Parking Lot #2 in their red outlined area in the plan. 

Are we going to get a similar transfer as part of our Freehold Purchase, or is this a separate negotiation with the Murfets?

Also noted that the TP1 states that the transfer comes with the obligation to continue honouring the existing rights granted to 93-95 Tenison Road.

Guess the interesting questions are
  1. If the Murfets do a TP1 with 95 Tenison Road, would they state that the transfer comes with the obligation to honour Flat 8's parking rights?
  2. If we do indeed get the TP1 (either as part of the current purchase or separate negotiation), can we let Flat 8 park at Disabled Slot 2?

Hi all,

If there are no objections I suggest we move ASAP towards resolving the parking issue in the following way:
  • do a TP1 claim to grab the disabled parking slot behind 93 Tenison Road (which is not included in the red boundaries of Lime Tree House's TP1 plan)
  • clarify the access rights with Lime Tree House, based on the planning application that created 8 flats @ 93 Tenison Road with a disabled parking space
  • lodge a Notice, if that helps
I am happy if Richard is able to help us do a TP1 as a follow-on project, if the cost is reasonable. Your thoughts?

Hi Claudia,

According to Richard the disabled car park can be used for any purpose, now that we are the landlord. 

The Council cannot do anything about private grounds.

Richard did mention that if no one claims it, it will remain under the ownership of the Murfets or the Liquidators. 

If you look at the planning document I included in my previous email, it does indicate we had one -- at least in theory, or historically.

A few thoughts: can a disabled car park be easily converted into a non disabled car park?
Is the car park currently being used by a disabled person?
Paul Dixon may have the answer to the question why the disabled car park has not been included in the freehold purchase for lime tree house, as he was directly involved with the sale.
In my opinion, Paul would be a better person to work on this with his prior knowledge.
