Dear Heather

Please see the email I have received from our contractor. I understood and indeed the minutes reflected that this had been agreed. I do not know who has contacted the council/highways agency to object. However, unless these objections are removed or action is taken by the freehold company to show their support, we will have missed our slot to have the works carried out. 

We have been more than patient and offered to pay for these works at considerable expense to us. However unless these works can go ahead immediately, I will be holding the freehold company liable for the costs incurred given that objections have been raised by other long leaseholders. I will be contacting the highways agency for confirmation as to who has objected next week unless this has been resolved.  Perhaps those who have raised objections would wish to contact me directly and explain this given it has been approved by the council and the freehold company. 

I was hoping that we could move on from this issue and have a good relationship with the other leaseholders. Obviously others do not feel this way. Please note that payment of the service charges will not be paid until this issue is resolved.

I would be grateful for your input in this matter without delay to resolve this.

Hi Mervyn, I have managed to contact the StreetWorks team, it would appear that the hold up is because, although it had been approved, there were objections from people in the property, I have requested new dates as we have now missed the slot we wanted this week, waiting for the approval now, Regards, John

Dear Helen,

I would be interested to know who is raising the objection and know exactly
what the objection is. This action is outside of due process. Everyone had
been notified, everyone had the chance to attend the meeting or send a
proxy, everyone had opportunity to have their say and vote.

The matter is finished and work should go ahead. I'm very disappointed to
hear about this delay - please let me know the updates. Or if I can be of
help providing minutes and witness, let me know what I can do. I had rather
hoped we had moved on.

The Company has been extremely patient with Flat 8’s year-long refusal to pay service charge. Regrettably we now have a well established precedence for leaseholders to resolve future issues by using financial threats.

What happened during the recent meeting was this:  
  • Heather and Claudia voted for the front parking solution, in a deal whereby Flat 8 releases the withheld service charges and Flat 8 pledges to fund the project privately. 
  • Graham’s email vote was invalid, because he did not appoint a proxy. 
  • I abstained due to concerns about the lack of terms and conditions (for accepting Flat 8’s financial undertaking), and the absence of any up-to-date drawings/plans. 
  • I also had doubts about the Highway Agency’s approval for the project. Permission was granted on 18 April 2012 to Mark Hansel, who was neither a freeholder nor a Management Company representative at that time. Recall that we formally decided to form a company on June 2012. The Highway Agency does not normally grant permission for tenants who propose to alter properties that they do not own.
After gaining Heather and Claudia’s votes, Flat 8 reneged on the promise to release the withheld service charge.  This is despite the Company satisfying Flat 8's demand to vote for "the only acceptable solution" before 28 Feb 2013.  

Before anyone had time to ratify the Company Minutes, Flat 8 instructed a contractor to commence work. 

Now I am shocked to learn that the Company has apparently agreed to be financially liable for project delays. I am unaware of such an important Company decision to financially guarantee the timely completion of the project. 

I would be very surprised if the Highway Agency has withdrawn Flat 8’s permission on the grounds of petty leaseholder disputes. Decisions are penultimate and very rarely revised. It appears that there are legitimate concerns. If such is the case, we should address the problems.

I would just like to state that the comments in Shien's email are not those of the company or on behalf of the company.  The decision for the parking space has been researched, discussed and voted on.  Work should now proceed.  

We will find out on Tuesday who placed the objection and on what grounds.
