Good evening all,

The final drafts of our restated governing documents are now complete! As a member, I’m very pleased with how they turned out, and I think you will be too. Please see the attached documents for review. Next, we will hold a town hall to discuss any significant proposed updates with the community, followed by a community vote. See below for important upcoming dates!

  • Voter List Correction Deadline - Apr 6th (corrections for names, address, etc)

Hi all,
Some comments came in regarding the final draft of the CC&Rs. I thought it'd be helpful for everyone to see the comments since they are likely not unique.
 
Comments:

1. Parking - there should be language that states owners should not be allowed to park their cars every day in the guest parking area. This is ridiculous that we allow this. We are struggling with guest parking all the time and it is because a few homes decide to either pack their garages with tons of stuff so their cars can’t fit in it or they purchased a third car. In addition, guests should not be able to park for more than two nights in a row either. There should be rules around that! It is so hard when I come to visit my tenant or I come to take care of the unit for some minor repairs that I have to park down the street somewhere!

We've considered this. Our attorney has advised and we agree, that parking rules are better situated in the Rules & Regulations (R&R) that can be changed more easily to address the community's current situation. CC&R restatement is a long process with a majority homeowner vote. R&R simply requires a vote of the participating quorum. CC&RS state that residents much follow R&R.
 

2. Pool - there should be language that states no animals should be allowed in the enclosed pool area. There have been a few violations and we even had dog poo in the hot tub once, remember? 

Common area conduct should be delegated to R&Rs, not CC&Rs. It's equally binding and enforceable, with fines, etc.


3. Windows - for clarification is the ccr saying that from this point moving forward the association will not be responsible for all windows even if they are the original ones? I would fully support this because why should the association continue to be responsible for ANY windows? This is crazy. When I bought my new place we were told no matter what the condition of the windows are, they are my responsibility. This will save the association a lot of headaches (and money). 

4. Trash - I haven’t seen anything that addresses this big issue. We have had consistent problems where people continue to behave un-neighborly.

5. Washing of Vehicles? - I see this in 10.11 and this is absurd. You can't wash your car near your garage? I think this is crazy.

Like the above, if you read the language carefully, we gave ourselves a loophole using our R&R. This allows our community to quickly adapt if a or multiple owner's car washing activities were egregious/very unneighborly.
