Is tower 16 Ready? (Atleast from outside). As per a mail from 3C they have applied for the OC of entire Phase 2, but based on what I saw 10 days back tower 16 was atleast 3 months away......koi magic wand ghumaya hai kaya?

Towers shall not be ready when applying for OC. Even paint is not needed as per Noida Authority. 

So 3C can easily apply for OC without construction/interior complete.

Tower 8-9-10 of LP were given OC in august 2013 where as possession is already 4 months away from now.

Just adding to what Amit shared about OC in earlier email. Here are some important points about getting an Occupancy Certificate from Noida Authority (I am not a lawyer, just referring to Noida Building Regulations from this link http://www.attachowk.com/Noida-Building-Regualations.pdf).

Important points about when to apply for OC (even though this has to be done/is done by 3C, this impacts us all of Lotus Boulevard flat owners)-

When Allottee submits the application for seeking the occupancy certificate without actually completing the building, inspection shall be done within 30days. If during the inspection for issue of completion certificate any building is found incomplete the allottee will be penalised 50% of occupancy charges or Rs. 5000/- which ever is more and his/her/their application for occupancy shall be rejected. On such rejection of application the allottee will be required to apply afresh along with penalty charges and time extension charges if required. The action against all the concerned Technical person who has prepared the plan will be taken in following steps 
i) First time – Warning to concerned Technical person 
ii) Second time – black listed in Authority for one year. 
iii) Third time – refer to Council of Architecture/ ITPI/ MIC for cancellation of Registration.

Implications of applying for OC -

No building erected, reerected, shall be occupied in whole or part until the issue of occupancycertificate by the Chief Executive Officer in the Form given in Appendix -11. Provided that if the Chief Executive Officer fails to issue the occupancy certificate or send any intimation showing his inability to issue such certificate within 60 days of the date of receipt of application for occupancy certificate an intimation to this effect shall have to be sent to the Authority by the owner for occupying the building and if no communication is sent to the applicant for a further periond of 30 days, the allottee may occupy the building after expiry of 30 days from the date of intimation received in the Authority.

In case objections are intimated by the Chief Executive Officer or by an authorized officer showing inability to issue occupancy certificate the owner shall take necessary action to remove the objections. If the objections remain un-removed for a period of 6 months the application for issue of occupancy certificate shall stand automatically rejected. Thereafter the Chief Executive Officer shall take suitable action for removal of unauthorised construction with fee. Thereafter, the applicant has to apply afresh with fee for occupancy certificate.

OC Criteria -

50 percent of maximum permissible ground coverage with provisions of a functional toilet / bath and
kitchen Provision of following items in building shall be mandatory for issue
of occupancy certificate.
a. Flooring;
b. Electrical wiring whereas electrical fittings shall not be mandatory.
c. Plumbing and fittings in at least one toilet and kitchen
d. Trees as per Table no. 6 or direction issued from time to time
which ever is higher;
e. Number plate;
f. Boundary wall shall be mandatory.
g. Internal and external finishing (Plastering and whitewashing shall
not be mandatory);
h. House shall be lockable i.e. all external doors and windows shall
have to be provided with grill provided in the windows then fixing
of glasses in the windows panes shall not be mandatory;
i. No violation of Building Regulations, Zonal Plan Regulations and
Master Plan should be there in the building at the time of issue of
occupancy certificate.

GROUP HOUSING (Flatted and cluster type)
I) Minimum Plot Area 2000 square meter.However, Authority may decide the minimum
area more than 2000sq.mtrs. for any scheme.
II) Maximum permissible –
I) Ground coverage 35 percent up to 40000sqmtrs and 40% above
40000 sq.mtrs.
II) Floor Area Ratio 2.75( 3.00 for YEIDA as previously prescribed)
III) Height No limit. For buildings above 30 meters in
height, clearance from Airport Authority shall
have to be taken.

By this logic either the occupance certificate has been denied or they have not applied.... had they applied they can give the posession after 90 days... correct me if I am wrong

Guys, spend 10 buck and file and RTI. Why hear shitty answers from builder and authorities.

Here is the RTI, 


Change the project and personal details, buy a postal order of 10/- from post office, send it to NA. DONE.

Amit is correct. He has drafted a RTI for Lotus Panache while I am enclosing a drafted RTI application seeking status of issue of OC in r/o Phase 2 of Lotus Boulevard. All you have to do is put your contact details and send a DD or Indian Postal Order of Rs 10/-. Let me see who all show the initiative to file one. While some ppl just shout or crib, others just do the job silently.
