there is an advance payment that has been made in a
construction linked plan?
The
builder is adjusting 100% of the demand money against the
surplus paid. How does the buyer withhold any TDS in such as
case?

Seems like no one knows what it is and everyone
has a expert advice.
First of all 1% is nothing to do with JP or non JP
properties, its is something where govt. has made it
mandate.
IT is applicable from 1st June 2013 on all
properties above 50 Lakhs
It is not the additional 1% for buyer , it is a payment
from 100% to Builder, so Buyers remains unaffected. This is
known as Tax Deduction and Source on future income to seller
or also called Withholding Tax. i.e. if you were initially
paying builder 50 L not you will pay 50K to Govt as TDS and
remaining 45L to Builder.
It can be easily paid at under form 26QB on following
link https://onlineservices.tin.egov-nsdl.com/etaxnew/tdsnontds.jsp
IT is also applicable for all properties bought before
1st June 2013 above 50 Lakhs under Constructions linked plan
and payment is yet to be made post 1st June 2013, but
applicable only on further payments.
All payments to be made in 7 days from the payment to
builder,
If this is not done builder will have no liability but
Income Tax authorities will catch the buyer.

need to pay 1% TDS. JP is un-necessarily harassing us.
Moreover, IT department will also take a its share,
later on. 50k-60k ka wahan kharcha every year till JP
delivers the apartment.
Noida
authorities/other land management authority anyway provides
details to IT department for all the transactions more
than 30 lakhs.
This
is step is creating lot of confusion among buyers. I'm
sure it will be withdrawn next year.
As
per expert advise, Under construction flat owners don't
have to pay 1% TDS if they have bought their flat
prior to 1st June, 2013 and they owe builder less than 50
lacs.

I agree with Pramod however Jaypee insisted that I have
to withhold 1% as TDS.I checked with the jaypee office and
they confirmed that it has to be paid on an amount excluding
taxes and surcharges and cess. Maybe they are awaiting
further clarity on this and meanwhile don't want to take
any chances since they have been in the news for wrong
reasons.
