Actually, it's not over. It was dismissed against two defendants for
plaintiff's failure to answer interrogatories.
It can be reinstated against those defendants within 60 days from the date
of the order, if the fee is paid and the interrogatories are answered. The
action is ongoing as to the remaining defendants.

There seems to be widespread misunderstanding of a basic concept. Over in
auk, for example, Aratzio tried to edify us all as to the difference between
a "counter suit" and a "counterclaim." Perhaps this will help:

I prepared many motions to compel and motions to dismiss in the years I
worked in law offices. This is SOP.

practical point of view, so one might as well make the other side work for
them. IOW, as I said, it's SOP.

60 days is 60 days in Law Division. I don't know what the rules are
elsewhere.
It really doesn't matter, though, because the case has only been dismissed
as to two defendants. It's still active as to the other served defendants.
That makes all the crowing not only premature but stupid.
I haven't seen anybody crowing, but now that I reread the (case) link I get
what you mean about it only being dismissed as far as Canon and Osterwald
are concerned.
