Dear all,

The new renters in 202 have moved in with an oversized German Shepherd. Two things are very clear in our condo docs: Renters must ask for permission, and there is a fee, which is, in my opinion, way too low.

We need to put the owners of Unit 202 on notice immediately. The owner, Felitas Agus, must write the board a letter requesting that a renter have a dog. A $25 fee must be assessed to the unit monthly along with the $100 rental fee. The board should discuss this at our next meeting and decide on a fine. The owner should also be informed that their renters must follow all condo rules, including animal behavior and responsibilities.

Special Restrictions for Rental Units:

No pets are allowed in rental units without explicit written permission from the Trustees. This is much stricter than the general rule.

Specifically for rental units:

  • Tenants cannot have pets unless they get advance written permission from the Trustees
  • The Trustees have "sole discretion" to grant or deny this permission
  • If permission is granted, there's an additional $25 per month pet fee that the unit owner must pay to the condominium
  • This fee is separate from the $100 monthly rental fee that all rental units must pay

The document references "Section (9)(C)(4) of the Master Deed" as the source for this rental unit pet restriction, indicating this rule has been in place in the condominium's governing documents for some time.

General Pet Rules (applies to all units):

  • Common household pets like dogs and cats are allowed unless prohibited by the Trustees
  • Pets must be leashed at all times in common areas
  • Pet owners are fully liable for any damage caused by their pets
  • Pets must be licensed and properly inoculated
  • If any unit owner complains that a pet is a nuisance, the Trustees can ban that specific pet after giving the owner 3 days' notice and a hearing

It’s a more than just mildly interested party to this discussion, (remember, I live just below them) I agree with Amy. Let’s get a notice out to them immediately and then discuss at our next meeting. What to do about fining the owners.

I want to ask Jonathan but they are not allowed dog without our approval. I don’t know the recourse but I’ll ask. This is an absentee owner showing typically no effort to read our rules. This one is clear as can be.

Dear Mr. Agus,

It has come to our attention that your tenants in Unit 202 may have a dog on the premises. According to our governing documents, specifically Section (9)(C)(4) of the Master Deed and Section (24) of our Rules and Regulations, tenants are prohibited from keeping pets without explicit written permission from the Board of Trustees.

Required Documentation: If you have already submitted a written request for pet permission, please provide a copy to our management company, Hofeller, at (617) 734-8500 within 10 business days of this notice.

If No Permission Was Obtained: You have 30 days from the date of this letter to either:

  1. Submit a written request for the Board to consider pet permission for your tenants, OR
  2. Ensure the pet is removed from the premises

Applicable Fees (if permission is granted):

  • Monthly pet fee: $25
  • Standard monthly rental fee: $100

Required Tenant Compliance: Your tenants must comply with all condominium rules, including:

  • Dogs must be leashed at all times in common areas
  • Owner liability for any damages caused by the pet
  • Proper licensing and vaccination of the pet

Next Steps: Failure to respond within the specified timeframe may result in violation proceedings and fines as outlined in our governing documents. We will schedule this matter for discussion at our next Board meeting.

I have attached their lease under provisions 18 it says no pets without express written permission from landlord they are managed by green ocean.
 
They have already been giving me a hard time because the management company did not give them a copy of their mailbox key and they want management to pay for the locksmith and everything else to be able to open their mailbox which I have denied.
