    I took care of this earlier. Their payment came in after the collections process was done so the payment didn't reflect. I have removed our fee and pulled it from collections. I have also reached out to the attorney to have their notices waived.

I assure you the SPA trustees have not directed anyone to place a lien on your property because of confusion about and/or a delay in paying an outstanding HOA fee.  This step was taken by the accounting department of The Dartmouth Group (TDG), our management company.   The Trustees will take steps to improve the accounting services provided to SPA by TDG, including issues related to communication with owners about monthly fees and their timely payment.  

 

I’ve alerted our property manager, Shannon Wanger (copied on this email), about your complaint.  You should be in touch with her to resolve the issue/remove any lien on your property.

Well ain’t this something…

Just a few thoughts and a little history.

When we put liens in the past against unit owners (Ron Simons and Unit C) the lawyer was able to collect the over due rent and according to Massachusetts law they can collect their legal fees. 

There is never a reason to a) send a lien to someone who has made a good faith effort, b) you have not sent adequate notice, it’s actually illegal to do this without correct noticing or c) send it quickly since we can hold up a 6D at any time to get paid. 

Not only did TDG spend legal time that they thought would be free but TDG spent their own time, Shannons and someone in their accounting department. All a waste of time that we need for other things.

Hi all,

I’m a little late to responding but it is SO upsetting that they put a lien on Eric’s unit. This is NOT okay. It could have (had) huge ramifications on Eric’s credit, credibility, etc. and it could happen to any of us. 

Do we think TDG understands the extent of this issue? They owe Eric an apology and need to prove to us that they are making a commitment to better oversight of their accounting/financial management. I think this alone could be due cause to fire them if needed. And, of course we will not pay any legal fees - in fact they should cover any issues/fees Eric incurred due to this mistake.

Thanks, Michael, for speaking with Kim. Sadly, I think incident should provide a lot of ammunition in our arguments around what they are not doing right in managing SPA, and as examples of costs we are incurring based on their negligence.

We arewriting regarding the improper lien that was placed against 205. This lien was placed in error due to your company’s inadequate communication systems and internal processes.

DEMAND FOR IMMEDIATE ACTION:
Your company must immediately take all necessary steps to remove this lien, including but not limited to:
  • Filing all required lien discharge/satisfaction documents with the appropriate Registry of Deeds
  • Providing written confirmation that the lien has been fully released
  • Ensuring no record of this erroneous lien remains in any public filings
LIABILITY FOR COSTS:
This lien was placed without proper authority and due entirely to your company’s operational failures. Therefore:
  • Neither the Association nor the unit owner will be responsible for ANY legal fees, administrative costs, or time charges related to correcting this error

I’m fine with sending a version of this notice to Kim et al. provided Jonathan, in his role as our informal legal advisor, thinks it is warranted and appropriately worded.  Perhaps Kim will take steps to remedy the shortcomings in her accounting department if there are consequences for TDG and not just for SPA owners.

Michael,

I was on the fence about sending it because we are sending so many emails with issues: the taxes, other billing issues, building management. I keep thinking there has to be a more unified way to get them to do their job.

But putting a lien on someone’s unit is a big mistake. I just looked at the check dispersal on Town Square and I didn’t see one for legal fees. Shannon has a limited capacity and for her this was a day’s work for SPA and it was a waste. That doesn’t include the never-ending time it has taken from us. Trying to manage our management company isn’t what I expected out of TDG. They should be better.

We could delay sending the letter until after my September 11 Teams call with Kim and Mike when this unit 205 issue will be my first issue raised.  Depending on Kim’s response, we could decide how to proceed with the formal letter.  ?

Actually, them firing us was one of my concerns. I think we need to be firm that putting a lien on a resident like this is absolutely unacceptable and that we certainly won’t accept any financial responsibility for their error. At the same time maybe we need a little wording at the end, leaving the door open for a discussion on how we can prevent this going forward.

Jonathan is on an electric bike with Sue and Dan today. 

I’ll make a simpler, less angry version at some point and show it to Jonathan. I’m thinking we just need them to understand we won’t pay for the cost of this and then start a search for a new management company. This is so exhausting. We shouldn’t have to work this hard.

I like the more neutral tone of your revised message.  I’ve made several edits to this revised text.   With possible further edits by and approval of additional trustees, I think you should send it tomorrow.   I will put Kim’s response to this message at the top of my list of topics to discuss with Kim/Mike on Sept. 11 .

    I took care of this earlier. Their payment came in after the collections process was done so the payment didn't reflect. I have removed our fee and pulled it from collections. I have also reached out to the attorney to have their notices waived.
