Hello All,

 

Please see the narrative below and attachment letter from the renter’s therapist informing us that the 100lb German Shepherd in unit 202 is an emotional support animal.  We are required to accommodate the animal.

The new tenants in unit 202 have a large German Shepherd living within the unit.  No pets are allowed by renters according to the bylaws.

 

The tenants will have to remove the dog are stiff penalties will apply to the unit owner ledger.

Actually, we can’t charge the fee…

This is a complex legal area where you need to be very careful. Here's what you should know:

Legal Framework:

  • Emotional Support Animals (ESAs) are protected under Fair Housing Act
  • ESAs are different from service animals and have different protections
  • Housing providers generally must make reasonable accommodations for ESAs, even in "no pets" buildings
  • However, condominiums may have different rules than typical rental housing

What You CAN Request:

  1. Documentation from a licensed mental health professional stating:
    • The person has a mental health disability
    • The ESA is necessary to afford equal opportunity to use/enjoy the dwelling
    • There's a relationship between the disability and the assistance the animal provides
  2. The letter should be recent (typically within one year)

What You CANNOT Do:

  • Ask about the specific nature of the disability
  • Require the animal to be trained or certified
  • Charge pet fees or deposits for legitimate ESAs
  • Demand medical records

Red Flags for Fraudulent ESAs:

  • Documentation from online "ESA registration" websites
  • Generic letters not specific to the individual
  • Letters from providers who haven't actually treated the person
  • Missing required elements in the documentation

Recommended Actions:

  1. Consult your condo association's attorney immediately
  2. Request proper documentation through official channels
  3. Have your attorney review any submitted documentation
  4. Follow Fair Housing Act procedures precisely

Important: Wrongfully denying a legitimate ESA request can result in significant federal discrimination claims. The legal landscape here is complex and the penalties for violations are severe. This absolutely requires professional legal guidance, not self-help enforcement.
