All, We currently have a 90 day window to pursue any MOU noncompliance issues associated with the Sprout’s market construction. I’ve been asked by SCPNA to contact the neighbors to list any MOU transgressions  and construction requirements that are not completed per the terms of the agreement. SCPNA thinks we need to do get our concerns together right away.  If possible please provide dates and times of any noted MOU violation. Below is my list. If you are not sure if something qualifies or not please go ahead and list it. We are asking that the MOU agreement, especially as it relates to ongoing operational issues and construction specifications be honored in full. With your help we gain some footing to do so. Even if your concerns just mirror my own please respond with your concurrence by email so we can assess how widespread the impact of any violations are and allow our collective voice to be heard. Thanks.

 

Ongoing issues:

 

  • Some neighbors have questioned whether the masonry used for the boundary walls, especially on the north side of the parking is compatible with the architectural standards in the neighborhood.   
  • Tree landscaping on the Garfield side was minimized to largely allow for a bike depot which was not part of the original plan. ( I personally am not objecting to the depot but it’s location should have been discussed with the neighbors and not installed in lieu of the designated trees). The MOU clearly addresses tree-scaping and visual screening of the parking area. On Garfield the tree-planting install falls short of the MOU requirement.
  • Reflective mirrors to my knowledge have not been installed in the alley’s L-shaped area.

 

 

Past violations:

 

  • Construction vehicles and workers parking on Garfield street during the construction process. The issue was finally taken seriously toward the end of May when Russell Perkins had his GC put up signage and enforce this provision of the MOU. By then the Sprouts lot was completed so that may have had more to do with compliance than anything else.
  • Consistent violations around start /stop times. Workers routinely arrived on site in April, May and June at 6AM Monday through Saturday. The MOU clearly had a start time of 7AM M-F and 8AM on Saturday.
  • On opening day we had a band playing at 6:15AM and a tractor trailer idling in the parking lot. The MOU clearly states tractor trailers cannot be received until 8AM. I don’t think we considered the possibility of cabaret shows, nevertheless I wouldn’t want a precedent set for these kinds of promotions.
  • Lot paving of the Spouts lot started at 5AM on Saturday 4-20-13.

Thirty minute parking on the street will effect neighborhood guests. I feel that may be a bit extreme.

  • And as others have mentioned, we are not very happy about the decision to restrict left turns from Garfield onto Colfax.  Forcing vehicles to go West, when they want to go East (or get to Colorado Blvd) just pushes them into the City Park neighborhood to get turned around.  How can this help with neighborhood traffic issues?  I thought the idea was to urge drivers onto the main arteries - like Colfax?  
Otherwise, we are very happy to have Sprouts in our neighborhood and hope we can work with the management and/or the city and state to find appropriate compromises and solutions.
