As Adrian mentioned, it was discussed that there was to be an increase to the reserve fund.  However, the estimate of the increase & the possible date was not & that is what is bothersome to me.   
 
I look forward to discussing with the group in January, this most recent increase so far & better communication so that we're not caught off guard again with such immediate financial demands.

This is in respnse to the questions you raised in your email of December  19.
 
It is the board's responsibiltiy to determine the annual operating budget and reserve fund contributions.
 
The 2010 budget was distributed to co-owners as soon as it could be finalized by the board.  As you know, the increase in fees is required to increase the reserve fund contributions to $45,000 per year, necessary to bring the reserve fund up to the level recommended in the reserve fund study. Copies of the reserve fund schedules, which showed the need for significant increases to reserve fund contributions, were distributed and discussed by co-owners at the October 15 AGM.
 
 As you correctly noted,  we had hoped to hold a special meeting in December to give co-owners an opportunity to meet with a representative from Building Sciences on garage repairs, and to provide details on the 2010 budget.  We have had to delay the special meeting until January to allow time to review the contractors' quotes on the work.

I was able to get a copy of the minutes from the October 2009 annual meeting from one of the co-owners.
 
Re. the increase to the reserve fund.  My understanding was that the board was to call a meeting of the co-owners in December 2009 to discuss this increase before it was finalized.  Instead, the report states that "effective January 1, 2010, the assessment to the owners for the common expenses will increase by 14%."  This increase is less than 2 weeks away & there are co-owners who may be on tight budget & such an increase has not given them enough notice to pay this increase. 
Why have we received such short notice?  Is this a decision that the Board can make without a vote by the co-owners?
 
As noted I have copied those who are members of the co-owners intranet at 148 Soudan.

Surely, we already tried getting pixies to attend our maintenance
needs. (That must have been the strategy.) It is clear now that any
pixies in the vicinity were so self-centred and bent on their own
agendas that they stubornly refused to attend to ours. What that
means is that now we're going to have to pony up. Whether we pay up
now or later, willingly or unwillingly, cheerfully or with rankor ...
none of us has the magic powers required to attend to things by any
other means.

Atrophy rules. The fees are going up or the building's coming down.

This was an idea the realestate agent who handled my purchase
mentioned as a lure ... but is it feasible?

If we could do it, it would certainly make the investments we are
making in the building worth while. Does anybody have any idea how we
should start?

This sounds like something interesting to look into.
I'm away from tomorrow & will be back on Tuesday but would be intersted in finding out the advantages & disadvantages of going from c-ownership to condo.

Its a good article. It sounds quite discouraging in terms of
converting, which doesn't strike me as entirely fair.

Interesting. I didn't realise i was part of a business venture! The higher city tax rating seems somewhat unfair if you are a co-owner and living in your 'percentage holding", ie: not making a profit. I also noted 'Before she launched the venture, she undertook a $400,000 upgrade of the building’s envelope and mechanical systems to ensure that buyers would not face surprise charges later for building maintenance.' What a pity that didn't happen here, and that investors could take their profits without re-investing enough of them back into the building. Is this a case of bad management by the Board and Property Management Company or do I just have 'Sucker' stamped across my forehead.

I've just received my package for the special meeting and the proposed charges for the repairs. This is very distressing. The management fees have just gone up by 14% and now I have to find another $250 per month. I'm not sure I can do this. I will probably have to sell my % share. To make matters worse, I will be away on business for the Jan 27th meeting.
I see Michelle Oja is resigning as President and moving out of the building. I wonder if this is because of these increases and how many more people will leave?
Is there anyone who wants to be nominated for President of the Board?

Yes, Michelle's place went up for sale in mid-Novemeber.  Interesting.
Yes, very much a crippling increase.  One that will have profound effects on many.  The price one pays for buying into a very old building.

Has anybody investigated the possibility of splitting hte job up so we
do the urgent stuff this year, pay for it, and then do another part of
the job? What would the impact of that be?

These would be questions to ask at the meeting. I think I will write down my questions etc. and email and give them to a Board member. I'm depressed by the whole thing and the way it is being handled.

I had signed up and paid for a course before the holidays -
unfortunately refunds aren't offered, so I won't be attending the

I have sent the following email to Gesse.
 
There are some of us who cannot attend this meeting because of previous commitments. We were wondering if there is a chance that the meeting can be rescheduled as we all have questions we would like to ask about the construction and payment plans. If this is not possible, can we email our questions to you to be discussed at the meeting in our absence? Also, is it possible to nominate someone for the Board position if that person is not attending the meeting?

With such an important meeting & not a lot of notice, they should have set up 2 meetings so that everyone could hear personally what 'wonders' are going to be done to this building.

Here is the reply from Gesse at Peer Property Management.
 
We cannot reschedule the meeting.  Notice was given well in advance and is dependent on the Engineer's availability.  We also will need to hold the meeting in January in order to start collecting for the waterproofing/garage repair project in February.
Yes, you could forward your questions in advance, and you can also nominate a proxy to attend on your behalf and ask your questions at the meeting.  (That's why a proxy form has been included in the package).
If you have specific questions you would like to send, we'll try to answer them.
 
If someone would like to stand for the Board of Directors who cannot attend the meeting, we would need to receive a written and signed letter from the person in advance of the meeting which states that the person accepts nomination to the Board of Directors and if elected at the January 27th Special Meeting, agrees to serve on the Board of Directors until the next AGM.  Then provided that we receive a nomination and a seconder, and the person is voted in, the person could be elected.  Without a written letter from the nominee, we could not elect them.  Generally someone needs to be present in order to accept nomination.  If we have received this acceptance in writing, and the person has been nominated, then the Co-owners should be able to elect him or her to the Board.
 
I am willing to stand for election if someone would like to nominate me. I do have some experience as I have served on the Board of the Ontario Society for Medical Technologists for 7 years. Three years were as President.

Thanks for the update.  I would gladly nominate you as president & will look at the forms when I get home from work this evening re. the nomination.
 
In regards to receiving any kind of notification from Peer & the Board.  This will be an issue that I will be bringing up next week at the meeting & that is a request that perhaps we can communicate with them via e-mail rather than by the snail mail.  I know that not everyone may have access to a computer & the Internet but having documents either mailed to us or slid under under apt. doors can take time for delivery.  Also there have been times when they claim that documents have been sent to me & in fact I have not received any delivery.  I think that this will be a better & more speedy way of communicating with everyone.

Hi Carol - you have my vote! I am going to try and be there toward the middle/end of the meeting... I have PT meetings at my school but I've tried to arrange them so I am done by 7 rather than 830 so I hope to be there for 730. Wondering if any of us (by the sounds of us on the internet) Me, Carol, Janet, Karen, Diana - anyone else? wants to have a quick meeting together before this Wed so as to just go over what the agenda is? Just a thought - also - who of this group is able to get to the actual meeting? Does anyone know the number of owners who are also residents here (i.e. how many units are owner occupied?) Lisa 407
