Sorry, I think I just automatically forwarded to my contacts. I guess it
would be a good time to update you on the trial information. The trial took
place in September.  The Jury was selected and any members in a pool of 30
that were Police Officers, in the Service, or a government employee were
excluded from the pool.  We were left with 8 women and four men with one
Native American on the jury.  The jury was never at any time informed Wayne
was a police officer and in the service.  I felt like he was stereotyped
being an indian on the reservation. Brian McCoy was charged Not Guilty with
the charge of second degree murder and Guilty on two counts. One for
Voluntary Manslaughter and the other was discharging a firearm in Indian
Country.  The family is awaiting a sentencing date in December.  Our Brother
has been gone a year and the families pain is like yesterday.  I think the
trial prolonged some closure and healing.  The lesser charge was ineffect
because of the proof of "heat of passion in the moment". A bunch of shit if
you ask me.  I am still pretty raw over things. Wayne was educated and
trained and not your average man. He had morals and lived by his creed. He
took the responsibilty to protect his family and died doing just that. I
know that in my heart and soul that If he had the chance to disarm Brian, He
could have very well.  The Defense hired some Yahoo from Chicago who showed
up with a wqooden dummy with angle of wound demonstration, and a theory.
Not in anyone testimony did it support the defense theory.  Wayne was
strong. He weighed in @ 180 pounds and a 3% body fat according to the
coroner.  I still say that he had the skill to take care of the situation if
he had the chance.
I know that being an Indian you are still just Government Property and they
will supress whatever information they deem necessary.  JUSTICE ??????????
Call it whatever, Not enough for me.
