Why? Because I refuse to roll over for someone whose first email in a
dispute is accusatory and arrogant?
If he's have been reasonable and polite from the start he'd have found me
reasonable and polite and I would have refunded without question
immediately.
I am not prepared to accept arrogant, sarcastic and belligerent emails from
people just because they think they have the right to do so based on their
status as a customer. Unfortunately this guy took exception to the fact that
I did not fold up in a wimpering heap at the tone of his emails.
I make no apologies for refusing to be browbeaten without reasonable cause.

He seems more like a stalker type. I had one of those once. Megabitch was
his/her name (Vince Vaughn was another). That bod sent out so many emails
around the time of my launching my site in 2000 that I had about 1000 replies
from people thinking I had actually sent them an email saying I would track
them down, kill them and rape them (possibly, in that order).
I had to reply to each of these telling them it wasn't me and could they
forward the details to their ISP so the person could be traced, and that
obviously this was not how one would want to promote a website.
Before getting my reply though, a few said "Bring it on!!", while a few with
brains realised it wasn't real and tracked the bastard down ISP-wise. My
favourite quote was one woman who emailed me with a line which I've
paraphrased a number of times since because it's very clever:
"How sad. I can't begin to imagine what you have inside your head instead of
brains."

There's a saying "you can't polish a turd". Equally I don't think you
can get any sort of fair reflection from a website like this.
If I'd bought this, I'd be well hacked off. "Removed from working
kit" means you saw it personally, with the lights on. Lightning
strikes _do_ happen, and selling such a blasted heath(kit) isn't on,
in my book.
However the right reaction for a seller here is to offer a refund for
a genuine mistake (shit does indeed happen). That seems to have
happened, so everyone ought to be happy. If I were the bidder here,
and I'd got my refund, I'd be leaving you +ve feedback of "Turned out
to be broken, got full refund - good service, thanks"
In the case of Aspergerboy here, I wonder why he even needs a terminal
server. It's not as if he's going to wire all his mates up, is it? He
could do that with a null-modem cable.
eBay is _not_ an IT Hardware auction. At real auctions you get to
poke stuff and sniff it for escaping smoke. If I'm dealing through
eBay I'm relying on the seller as my agent (bizarre though that
sounds) and they have to accept some responsibility for reasonable
accuracy in descriptions of condition.
I wasted all of this morning because my USB hub decided to cash in its
chips. Should I sue someone, or write an insulting website instead ?
Maybe I'll just get on with my life instead.

clearance" rather than "found in a store room".
I wouldn't have treated a seller like that in the first place. Used kit
sold untested is always a gamble - Niel isn't one of those twonks who
describes known-dead kit as untested.

I'd be interested to see the guy's website logs. I bet this thread has
bumped it up somewhat, which presumably is having the counterproductive
result of encouraging him.
I found the site rather depressing, it's sad to see so much effort
wasted for so little point. Who wants to read his little rants; it's
not exactly "Grumpy Old Men" quality, is it?
Perhaps, Niel, the lesson to take home here is not to bait someone
who's life appears to consist of finding stupid causes to rant about.
Still my sympathy, we all get the odd nutter, now and then but better
to ignore and move on.

Nope, his ISP seem to be quite happy to leave it up and have informed me
they will only consider removing the site on instruction from an appropriate
legal authority.
TBH from what I have read in this newsgroup from those who have commented I
think it does more harm to the author's credibility than mine and it's not
really worth my paying through the nose for my solicitor to spend time
considering it & drafting a letter for the ISP to *consider*.

Corporate clearances have to be completed very quickly, and the money
involved does not permit exhaustive testing of every recovered
component. Buyers have the chance of picking up stonking bargains,
but it's unrealistic to imagine that a £56 item will have been
dismantled, examined & tested by a skilled technician.
NH was explicit about the uncertain condition of the device, and in my
experience he would've refunded on it cheerfully if the buyer hadn't
launched into an abusive crusade. He has a very good rep in the trade.
While you don't deserve the verbal abuse, if what he says is true your
actual Customer Service doesn't come across well, in my opinion.

did no ask him to do this) was met with a torrent of similar abuse and also
complained to his ISP, he got the following reply (copied and pasted):
"It should have be clear from the title and content of the article that Mr
