The break-up of the General Frame Agreement for Peace ("Dayton accords",
Paris December 1995) has very heavy consequences. This decision is more
important than the signing of peace which led to Federation, or even the
cancellation of the Croat Republic of Herceg-Bosna : this decision is the
same level as the cancellation of Lisbon accords, in 1992. The case is no
more of "obstruction" (which may lead democratically elected leaders to be
dismissed) or simple violation (like an arbitration commission over-passing
it's mandate), it's a not even a denouncement by one party, it's a
cancellation pronounced by a small board but so far accepted by the acting
members of the Peace Implementation Council.
FACTS
The arbitration tribunal didn't answer the question it was mandated to
answer, to confirm or redraw the Inter-Entity Boundary Line in the Brcko
area.
It confirmed its concern with the "governance of the Brcko municipality",
which was not mentioned in its initial mandate, the mandate given by Article
5/Annex 2 of the GFAP and accepted by both parties upon these terms.
It created a third entity, the "self-governing neutral district", "beyond
the control of either entity" ("both must surrender control" in the designed
area).
END OF STATUS QUO
From a cinematic point of view, this change in a more than three-year long
strategic equilibrium is a big risk taken. And ending this status quo and
"time will do it" situation just after disarming the local serb forces (the
very opportune weapon-smuggling incident) and reinforcing the
bosnian-serbian frontier (as if the Yugoslavian army could reactů) was an
additional risk (or choice), like giving to the Armija a "just do it"
signal.
GENERATING DISSATISFACTION
From a strategic point of view, Brcko is only of vital importance for the
Republika Srpska. The heaviest importance it has for the Federation is
precisely for being this weakest, and so important, point for the RS.
Deciding to take it back from the RS, without consequently giving it to the
Federation, was the best to dissatisfy both sides. Specifically, stating
that "the territorial continuity of the RS will be ensured" and "military
transit will be permitted" (which are only words) is the best way to provoke
the Federation strongest reaction and the "chaos" situation announced two
months ago by Alija Izetbegovic.
CONSTITUTIONAL ROLE FOR SFOR
From the legal and constitutional point of view, the new role given to
foreign troops in the constitution of the new entity ("military transit will
be permitted under SFOR regulation"), without any limitation in time, if it
is confirmed by the Peace Implementation Council, the Office of High
Representative and the National Assembly, is a settling-down of the current
temporary protectorate.
INTRODUCTION OF FURTHER MINOR PROBLEMS
The creation of the third entity is the opened door for the Croat community
to insist on having its own Herzegovinian/Posavinian entity.
"The new government will be democratic" rises again the question whether a
foreign protector can impose, whithin a local government, a party which
boycotted the elections and was backed by its electors in refusing to
participate.
"The tribunal also emphasizes the importance it places on Serb returns to
the Federation, particularly Sarajevo", rises the question of whether some
Serbs currently living, fort example, in Brcko, should be deportated to
Sarajevo, or whether the capital should become a neutral district on a
"condominium basis", after so many accusations made last year by the
international community for Croats leaving from Sarajevo and the city not
favoring Christian returns ("the tribunal emphasizes that the creation of
the new Districtů to impede the two-way return of war-time displaced
persons").

MN: 99.9% sam siguran da PTT BiH nema imenik na internetu. Jedine dvije
drzave bivse Yu koje to imaju su Hrvatska i Slovenija. Mada ako koristis
Hrvatski imenik na internetu, tu imaju i telefonski brojevi u Hercegovini.
