Have you ever worked a case in which an older person who made troubling decisions seemed to have the decision-making capacity to do so, but your gut instinct told you something was wrong?  It may have been a case of undue influence, which is a psychological process – often compared to brainwashing – that is sometimes used to facilitate financial exploitation or sexual abuse.  The practice and policy implications of these cases make this Webinar valuable to OAA Title IIIB legal providers, Legal Assistance Developers, and senior legal helpline staff, as well as to private elder law practitioners, adult protective services staff, law enforcement officers, and prosecutors.

This Webinar will provide an overview of:
1. The concept of undue influence and its role in elder abuse cases;
2. Characteristics of victims and perpetrators;
3. The relationship between decision-making capacity, consent, and undue influence;
4. The pattern of tactics and process used;
5. Frameworks for identifying, investigating, and proving undue influence;
6. Legal remedies;
7. The realities of undue influence cases; and
8. Resources for more information.

The presenter is Lori Stiegel, Senior Attorney, American Bar Association Commission on Law and Aging.
