This is an interesting case because obviously Donovan was being an ass and deserves whatever he gets, but I was taught that if you rear end someone you're at fault.

This isn't completely correct -- it's discussed here:

There's a lot of cases where I think felony charges are appropriate and it's interesting that in this case they're actually filed.

"Cyclist was clearly traveling at an unsafe speed because he rear ended the Tesla". Amusing given that the Tesla had just passed the cyclist..

Wasn't there a case a few years back in Southern California where a dude was convicted of vehicular homicide for doing something similar on a descent? 

My memory is saying a doctor in a 350Z passed and brake checked a couple of cyclist and they went through his rear window.

Hello SF2Gers,

An eventful weekend, still inexplicable. Some notes:
- Not riding 2 abreast - didn't know the cyclist behind me, but we were single file on the shoulder
- Not blocking any cars - others passed fine. There are just blind corners on Hwy 1.
- He didn't "block me from passing"; he was swerving, I was dodging - then he brake checked. Took me 2 seconds to figure out what was happening because until that moment I was just riding up Hwy 1 on a very nice Saturday morning. After that it was pretty damned terrifying.

Miss the ride down. Hope you guys are well and enjoying less eventful rides.

Similar thing happened to me on Saturday, a motorist drove up from behind and started honking/swearing at me then proceeded to move in front of me cutting into the bike lane and hit the breaks. Luckily I wasn't moving at a very high speed at the time and was able to brake safely. The guy was apparently pissed because I "almost hit him" while passing a car coming down by the windmill in Golden Gate Park where there is no bike lane. Sort of ironic that while he was so angry about "almost" getting hit, his response was to brake in the bike lane in what seemed like an attempt to get me to crash into his rear window. Stay safe everyone and be sure to report this kind of aggressive/dangerous behavior from other road users.
