Unlawful Possession of a Weapon

On 9/25/16 at 11:13p.m., Ptl. Jose Morales of the Newton Police Department stopped a Chevrolet pick-up truck on Water Street for speeding.
The operator was identified to be Duncan Graham, age 22, of Valley Road in Wantage, N.J.
From outside the vehicle, officers observed a handgun to be present on the rear floor within reach of the driver. This handgun was a fully loaded Smith and Wesson M&P 9mm which was owned by Graham but he did not have a permit to carry a handgun.
As a result, Graham was placed under arrest and charged with the following offense:
N.J.S. 2C:39-5 Unlawful Possession of Weapon (2nd Degree).
Graham was also issued a summons for speeding.
He was then lodged in the Sussex County Jail in default of $50,000 No 10% bail set by Judge John E. Mulhern.
