On 7/9/12 at 8:52p.m., Special Officer Raul Couce conducted a motor vehicle stop on High Street for a motorist failing to yield to a pedestrian in a crosswalk on Spring Street.


Subsequently, the vehicle’s operator, identified as Victor Albert 3rd, repeatedly refused to provide his credentials as required (driver’s license, registration, proof of insurance) to S/O Couce despite his numerous requests.  As a result of his failure to cooperate as directed, he was informed that he was under arrest and despite this, he continued to refuse to unlock his vehicle, exit his vehicle or comply with S/O Couce’s lawful orders.  Ultimately, S/O Couce was able to convince Albert to roll his window partially down which enabled him to gain access to the vehicle.  


Albert was then was taken into custody and charged with the following offenses:

N.J.S. 2C:29-1a   Obstruction of a Governmental Function (Disorderly Persons)

N.J.S. 2C:29-2a   Resisting Arrest  (Disorderly Persons Offense)

39:4-36   Failure to Yield to a Pedestrian In a Crosswalk  

39:3-29   Failure to Exhibit Documents (Registration and Driver’s License)

39:4-57   Failure to Comply with an Officer’s Direction

 

Albert was processed and released on his own recognizance pending a 7/21/15 appearance in Newton Municipal Court.
