On 1/5/19 at 10:24p.m., Ptl. Jared Zappa stopped a 2004 Jeep Liberty on Water Street for having an inoperable brake light.  The driver (later identified to be David Torre, age 38 of Tobyhanna, PA) initially provided false information to the officer concerning his true identity.

An adult passenger, identified to be Jennifer Kaplan, age 35, also of Tobyhanna, PA also provided the same false name for the driver indicating that he was her brother.


However, an investigation revealed Torre’s actual identity and that he was operating a motor vehicle while under the influence with a minor backseat passenger in the vehicle.  Torre also had an outstanding FTA warrant out of Andover Twp. Municipal Court.


As a result, Torre was charged with the following:

N.J.S. 2C:29:3b(4)  Hindering Apprehension (Disorderly Persons)

N.J.S. 2C:29-1a      Obstruction (Disorderly Persons)

 

39:4-50           Operating a motor vehicle while under the influence

39:4-50(G)(2) DWI In A School Crosswalk   

39:3-40           Driving While Suspended

39:3-10           Unlicensed Driver

39:3-66           Failure to Maintain Lamps

39:8-1             Failure to Inspect

39:4-50.15B   Driving While Intoxicated With Child in Vehicle

 

Kaplan was charged with the following:

N.J.S. 2C:-29-3a(7)  Hindering Apprehension (Disorderly Persons)

2C:29-1a                   Obstruction (Disorderly Persons)

 

39:4-50a       Allowing an intoxicated driver to operate her motor vehicle

39:3-40h       Allowing a suspended driver to operate a motor vehicle

 

Torre was lodged in the Sussex County Jail.  Kaplan was released after being served with a complaint.

Matter is pending a 1/15/19 court appearance.
