Arrest -Burglary, Theft (2 Counts), Possession of CDS, Resisting Arrest

On 8/9/17 at 6:33p.m., Newton Police were called to the area of 271 Spring Street for a report of an unknown male who had entered an occupied apartment without permission or consent.


Upon arrival, responding officers located a male matching the provided description to be present across the street and identified him as Shayne Divito, age 21, of South Shore Drive, Wantage, NJ.


Subsequent investigation revealed that Divito was under the influence and had not only entered the victim’s apartment and stole a cigarette lighter from the resident’s pocketbook, but had also stolen a wallet from another victim’s unlocked motor vehicle which that was parked in a lot across the street.  Lighter in question along with the wallet and all of its contents were recovered and returned to their owners.


As patrols took Divito into custody, he resisted arrest by attempting to flee before being subdued and arrested.


A search incident to arrest led to the discovery of a small blue bottle that contained 42 Ativan pills that he did not possess a prescription for.

As a result, Divito was charged with the following offenses:

N.J.S. 2C:18-2a(1)    Burglary        (3rd Degree)

N.J.S. 2C:20-3a        Theft of Moveable Property  (Disorderly Persons) (2 Counts)

N.J.S. 2C:35-10a(1)  Possession of C.D.S.  (3rd Degree) (Ativan-Schedule 4 Narcotic)  

N.J.S. 2C:29-2a(2)    Resisting Arrest (4th Degree)

 

Divito was processed and released pending a mandatory appearance date of 8/30/17 in Sussex County Superior Court.
