Drug Arrest -Possession of PLD, paraphernalia - Obstruction, Resisting Arrest

On April 15th, 2017 at 3:20pm, Newton Police Special Officer Don Donofrio observed a male subject, later identified as James L. Muller, age 27, ingesting a substance in the area of #120 Spring Street.  The officer approached the individual and observed in his bag, in plain sight, syringes.  Muller did not have a valid prescription for the syringes and when the officer was in the process of taking Muller into custody, he physically pulled away and ran down Moran Street.


Newton patrols in the area engaged in a foot pursuit with resulted in Muller being placed into custody.  Search, incident to arrest, provided that in Muller's possession were syringes, non-prescribed prescription legend drugs and drug paraphernalia.  As a result, Muller was charged with the following:

 

N.J.S. 2C:29-2a(2) Resisting Arrest (4th Degree)

N.J.S. 2C:29-1a  Obstruction (Disorderly Person)

N.J.S .2C:5-10.5e Possession of Prescription Legend Drugs (Disorderly Persons) (2 Counts)

N.J.S. 2C:36-6a Possession of Hypodermic Needles (Disorderly Persons)

N.J.S. 2C:36-2. Possession of Drug Paraphernalia (Disorderly Persons)


Muller was processed and released pending court.
