Dear Friends,

Uttar Pradesh Election Watch and Association for Democratic Reforms (ADR) have analysed the self-sworn affidavits of 402 out of 403 newly elected MLAs in the Uttar Pradesh 2017 Assembly Elections.  There is one MLA namely Rakesh Pratap Singh from Samajwadi party, won from Gaurigabj constituency whose affidavit has not been analysed.

Criminal background

 

·        

Criteria for serious criminal cases

1.        Offence for which maximum punishment is of 5 years or more.

2.        If an offence is non-bailable

3.        If it is an electoral offence (for eg. IPC 171E or bribery)

4.        Offence related to loss to exchequer

5.        Offences that are assault, murder, kidnap, rape related

6.        Offences that are mentioned in Representation of the People Act (Section 8)

7.        Offences under Prevention of Corruption Act

8.        Crimes against women.

 

MLAs with criminal cases:Out of the 402 MLAs analysed, 143(36%) MLAs have declared criminal cases against themselves. Out of these 403 MLAs analyzed for Uttar Pradesh 2012 Assembly Elections, 189 (47%) have declared criminal cases against them.

·         MLAs with serious criminal cases:107(26%) MLAs have declared serious criminal cases including cases related to murder, attempt to murder etc. Out of 403 MLAs analysed during Uttar Pradesh Assembly elections in 2012, 98 (24%) MLAs had declared serious criminal cases against themselves.

·         MLAs with cases related to murder: 8 MLAs have declared cases related to murder (IPC Section 302) against themselves.

·         MLAS with cases related to attempt to murder: 34 MLAs have declared cases related to attempt to murder (IPC Section 307) against themselves.

·         MLAs with cases related to crime against women : 1  BJP MLA namely Ashok Kumar Rana won from Dhampur constituency has declared case related to crime against women, such as assault or criminal force to woman with intent to outrage her modesty (IPC Section-354).

·         Party wise MLAs with criminal cases:114(37%)out of 312 MLAs from BJP, 14(30%) out of 46 MLAs from SP, 5 (26%) out of 19 MLAs from BSP, 1(14%) out of 7 MLAs from INC  and 3 (100%) out 3 Independent MLAs have declared criminal cases against themselves in their affidavits.

·         Party wise MLAs with serious criminal cases:  83(27%)out of 312 MLAs from BJP, 11(24%) out of 46 MLAs from SP, 4 (21%) out of 19 MLAs from BSP, 1(14%) out of 7 MLAs from INC  and 3 (100%) out 3 Independent MLAs have declared serious criminal cases against themselves in their affidavits.

·         Crorepati MLAs: Out of the 402 newly elected MLAs analysed, 322 (80%) are crorepatis. Out of 403 MLAs analysed during Uttar Pradesh 2012 assembly elections, 271(67%) MLAs were crorepatis.

 

·         Low asset MLAs:3 MLAs in Uttar Pradesh  with lowest assets have their assets valued less than Rs 10 lakhs, and they are as follows:

·         Average assets:The average of assets per MLA who won in the Uttar Pradesh  2017 assembly elections is Rs.5.92 crores whereas the average asset for each candidate who contested in the 2017 assembly elections was Rs 1.90 crores.In 2012, the average assets per MLA analyzed was Rs 3.36 crores .

·         Party wise average assets:Among major parties, the average assets per MLA for 312 BJP MLAs analysed is Rs 5.07 crores, 46 SP MLAs have average assets of Rs 5.84 crores, 19 BSP MLAs have average assets of Rs 17.84 crores  and 7 INC MLAs have average assets worth of Rs 10.06 crores.

·         MLAs with high liabilities: 50 MLAs have declared liabilities of Rs1 crore and above, and the details of the top 3 MLAs are as follows:

·         Average assets of re-elected MLAs in 2017:The average assets of re-elected MLAs in 2017 is Rs 8.62 crores

·         Average growth in assets of re-elected MLAs from 2012 to 2017:The growth in average assets of re-elected MLAs is Rs 4 crores i.e. by 87%.

Other background details

·         Education Details of MLAs:  101 (25%) MLAs have declared their education qualification to be between 8th pass and 12th pass while 290 (72%) MLAs have declared having an educational qualification of graduate or above.

 

·         Age details of MLAs:201 (50%) MLAs have declared their age to be between 25 and 50 years while 201 (50%) MLAs have declared their age to be between 51 and 80 years.

 

Gender details of MLAs:Out of  402 MLAs, 40(10%) MLAs are women. In 2012, out of 403 MLAs, 32 (8%) MLAs were women.
