Bug using with binding in 3.4.1 version

I'm geting an error when using the "with binding" like this: data-bind="with: $root.getData.bind($data)", the error occurs when an observable used inside the function getData changes, the library try to re-bind the div but is already binded so give this message: "You cannot apply bindings multiple times to the same element"
