Sub - Complaint  against unlawful favour to various builders / developers by the Officials of Town & Country Planning Department during award of License to develop Residential townships , checking of Services laid in Residential townships , Construction of Community Buildings Residential townships , Sale of common area and violation of FAR in Residential townships , Possession of property to property buyers without occupation certificate and completion not obtained even after the expiry of time limit under the Haryana Development and Regulation of Urban Areas Act 1975 & Rules , 1976 and THE HARYANA APARTMENT OWNERSHIP ACT, 1983.


This has in the reference to the subject sited above . 

The Town & Country Planning Department was supposed to work as regulator for Builders and Buyers but unfortunately all the activity converted as facilitator of Builders . Higher Authorities of Town & Country Planning Department not respond to National Capital Region Planning Board even .

I have ample proof of violations by builders and license given to builders were beyond the rules and regulation . One classic example is of M/s Anant Raj Builders for  Anant Raj Estate , 63- A , Gurgaon . The license granted for Plotted Residential colony . Sector 63-A , Gurgaon was taken in R zone through notification 24/5/2011 and the mandatory provision for 100 acres land in one stretch was outright y ignored  in this case and in many cases too. Why ? Is this act is not fall under the undue favour to Bussiness House ?

First license was awarded to M/s DLF Ltd in 1981 and till date none of the builder / Licensee has obtained COMPLETION CERTIFICATE so far . The is huge loss to Government of Haryana . The builders have been enjoying many facilities on such townships those should fall under the Land bank of Corporations or Board of Property owners .

On various complaints notices were issued but no action have been initiated on violations given in subject .

What STP , Enforcement Town & Country Planning Department has been doing ? How many times He visited the projects ? This situation is when many cases are pending in Courts and thousands of complaints are laying unattended .

The complaint information on Financial Loss to THE STATE OF HARYANA , Violation of the Haryana Development and Regulation of Urban Areas Act 1975 & Rules , 1976 and THE HARYANA APARTMENT OWNERSHIP ACT, 1983 and injustice to the People of India .

The Government has 60 days to take action otherwise we will take legal action as we have submitted many complaints on various violations but no action seen so far .

2. Requirements of prior Environmental Clearance (EC):- The following projects or activities shall require prior environmental clearance from the concerned regulatory authority, which shall hereinafter referred to be as the Central Government in the Ministry of Environment and Forests for matters falling under Category ‘A’ in the Schedule and at State level the State Environment Impact Assessment Authority (SEIAA) for matters falling under Category ‘B’ in the said Schedule, before any construction work, or preparation of land by the project management except for securing the land, is started on the project or activity:

(i) All new projects or activities listed in the Schedule to this notification;

(ii) Expansion and modernization of existing projects or activities listed in the Schedule to this notification with addition of capacity beyond the limits specified for the concerned sector, that is, projects or activities which cross the threshold limits given in the Schedule, after expansion or modernization;

(iii) Any change in product - mix in an existing manufacturing unit included in Schedule beyond the specified range.
