Contributing and the EE License

I hope this is a reasonable plaice to post a meta issue like this.

Here is my current understanding:
  1. Gitlab CE is free and open source.
  2. Gitlab EE is proprietary and open source.
  3. Gitlab.com runs Gitlab EE.
And here's the part of the license that has me confused:

GitLab and/or its
licensors (as applicable) retain all right, title and interest in and to all
Software incorporated in such modifications and/or patches, and all such
Software may only be used, copied, modified, displayed, distributed, or
otherwise exploited with a valid GitLab Enterprise Edition subscription

I'm currently a gitlab.com user and interested in contributing to features that seem to be EE-only. To be legally compliant, wouldn't I have to purchase a subscription in order to make a pull request to gitlab-ee?
