TRURO - A retired Air Force sergeant formerly from the Onslow-area has
been found guilty of sexually assaulting a 10-year-old boy by
touching.
In handing down the ruling against Richard McCully, 50, Judge John
MacDougall denounced the man's version of events and accepted the
testimony of his young victim, now 11.
"The evidence he (McCully) gave was such that it was self-serving,
that it was limited and that it was structured so as to make it up as
you go along," MacDougall said.
"He did everything in his power, in my opinion, to suggest that he was
being taken advantage of ... his testimony was well-scripted and
well-rehearsed."
The judge suggested McCully had attempted to fabricate evidence to fit
his version of events but had failed because of the combined efforts
of the Crown's cross examination and the boy's more credible
testimony.
"I don't accept the evidence of Mr. McCully as to his interpretation
of facts," MacDougall said. "He was found to be an uncredible
witness."
McCully, who now lives in Edmonton, spent 30 years as a member of the
Canadian Forces before retiring last year.
Court evidence revealed the assault occurred following a get-together
at the boy's home, held in part as a retiring party for McCully who
was home for a visit. He accepted an invitation to spend the night
after consuming too much alcohol to drive. Around 3 a.m., however,
McCully left his spot on the couch, crawled into bed with the young
boy and attempted to fondle him.
The boy testified an attempt was also made by McCully to pull his hand
toward the man's genital area. But MacDougall said he could not
determine beyond a reasonable doubt whether that was the case, or
whether McCully was trying to subdue the boy in his "aggressive"
attempt to "get the heck out of there."
McCully, who is gay, said he was simply trying to move the boy into
his brother's bedroom so that he could spend the rest of the night in
that bed, after waking up with a sore hip from sleeping on the couch.
After fleeing McCully's clutches the boy ran into his brother's
bedroom before eventually crawling into bed with his parents, which
ultimately brought the incident to his mother's attention.
Following the hearing, the boy's mother said she felt satisfied with
the judge's ruling and overall assessment of the evidence.
"I think it went well," she said. "And I'm happy it was a guilty
verdict on one count. I accept the judge's reason for not giving a
guilty verdict on the second count."
McCully is to be sentenced July 17. In the meantime, a pre-sentence
report has been ordered along with a requirement that McCully undergo
a sexual offender assessment to determine whether he is a threat to
reoffend.
Until then, McCully must report to the Edmonton Police every Friday
and is banned from being in the company of anyone under the age of 14,
from any public park, swimming area, community centre, school,
playground or other areas where children are present. He also cannot
take any employment or be in a position of trust for anyone under age
14.
One exception to the public ban is at Hermitage Park where where (Nice

walk his dog.
