Surrey RCMP Cpl. Lorne Lecker is being sued by his estranged brother,
Seymour Lecker of Port Alice, for upwards of $300,000 for violating
his privacy by using a police computer to locate him and identify his
as a person of interest in a 2005 firebombing.

A Surrey Mountie, believing his estranged brother might be a "person
of interest" in a firebombing of the Port Mann detachment, used the
RCMP computer databases to track him down.

A search of B.C. newspaper files reveals the firebombing -- and a
subsequent firebombing of police cars -- was not reported. The crimes
have not been solved.

The firebombing of the Port Mann detachment was disclosed in a ruling
by B.C. Supreme Court Justice William Ehrcke last week in which he
dismissed an application by Seymour Lecker for a summary judgment
against his brother, RCMP Cpl. Lorne Lecker.

The detachment was firebombed in September 2005 while the corporal was
assigned to the Lower Mainland District Traffic Services, Port Mann
detachment.

Seymour Lecker, trained in the use of explosives in the Israeli
military, claimed that since his brother was not part of the
investigation team in the bombing, it was a violation of his right to
privacy for his brother to use the police computer to locate him.

He is seeking upwards of $300,000 in damages against his brother.

In a writ of summons filed in Campbell River, Seymour Lecker of Port
Alice said he suffered "humiliation, emotional distress, diminution of
reputation and loss of enjoyment of life."

He said he's been called "007" as a result of RCMP activity around his
home and the events happened while his wife was recovering from a
life-threatening medical situation.

The officer, who is now working in the Surrey RCMP traffic section,
opposed his brother's application for a summary judgment. Such a
ruling would mean the judge had found the complainant's rights were
damaged, on the basis of affidavits and without a full trial, and the
case would proceed to the penalty phase.

The officer argued that he had acted with lawful authority, had a
triable defence and desired that the matter go to a full civil trial.

Ehrcke said it was not for him to make a final determination as to
whether all or any of the defences offered by the cop would succeed,
but said it was sufficient to say he had raised "bona fide triable
defences" and the plaintiff's claim was not bound to succeed. He
therefore dismissed the application and ordered the case to go to
trial.

The judge said Seymour Lecker "deeply disliked" his brother and the
two had not had contact since 1998.

Ehrcke noted that the police officer accessed the computer database
after the firebombing. The officer then advised his superiors of his
estranged relationship with his brother, his brother's training in the
use of explosives in the Israeli military in the 1970s and the fact
that he'd recently obtained a B.C. driver's licence.

However, the brother "deposes in his affidavit that he has never been
arrested or detained in relation to the September 2005 firebombing,"
said Ehrcke. "He says he was informed by Chief Supt. [Keith] MacRae
and by corporals P. Hudson and C. Heisler of the Surrey RCMP
detachment serious-crimes unit that he never rose to the level of
being a suspect, and that he only became a person of interest after
the defendant used the RCMP computer system to obtain his address."

Seymour Lecker said he'd done his best to keep his address private and
did not want his brother to find him. He'd returned to North America
from Israel in 1980 and had lived in Ontario, B.C., Vermont, New York,
Louisiana and Texas.

He refused to attend his brother's wedding, his graduation from the
RCMP and the funerals of their parents.

RCMP Const. Annie Linteau said there was an internal code-of-conduct
investigation after Seymour Lecker lodged a complaint, but the probe
found that his brother had done nothing wrong in checking the
databases.

In addition, a complaint by Seymour Lecker to the Commission for
Public Complaints against the RCMP also found no wrongdoing, she said.

Linteau confirmed that there was a firebombing but couldn't say how
much damage was done. No one was injured.

She said several police vehicles were damaged in a related incident
when explosive devices were put under the cars. No one was injured.

Greg-Seems odd this was kept form the media. Where we ever going to be
informed that equipment owned by the Cdn ppl had been destroyed? Isn't
the fire department supposed to know something about this? What a
shameful occurrence. I'm not surprised that the police investigated
the brother seems like an obvious suspect to me.

RCMP chopper is right now flying over the 150St and 104 Ave area with
its searchlight on. First time I have seen that in this area. There
was a loud domestic dispute going on the third floor of one of the
apartments on 150 St. Breaking glass and shouted orders and insults
but they wouldn't need a chopper for that.

The other afternoon as I left for work a Black man with a black cap
took my picture with a cell phone, a white dude with short hair in a
van said, " HA were not going to hurt you, just cut your beard". I
said, "Not going to happen".. He then drove off in his van (at least
the second time I have seen him around). Two Caucasian males with
their shirts off were seemingly a part of it and one of the
neighbourinos (the only other person I recognized) gave them the
finger so they shortly left. No one gave any support to the HA ppl.

Congrats to the US basketball team for winning the gold and the
Spaniards for finishing with silver. Congrats to the Cdn team for 18
medals which is more than they got at either of the last two Olympics
and more per capita than China, USA, Russia or Japan managed. C A N A
