Received a CDR short questionnaire today.

SSA-455-OCR-SM

Oddly, and then maybe not so, it is dated Aug 13, but arrived today Oct.
12. I get mail all the time so I don't understand th edelay.

The instruction letter says I have 30 days to respond.

30 days from receipt, or 30 days from the date they put on it?

I just happen to have doctor's appointments next week so if I hold this
till Oct 21 I can list the most recent, otherwise the last were 6 months
back fo rsome, 3 months for others. I see 3 doctors in a rotating
sequence.

Suggestions?

This 455 was lost in the mail or else sitting on someone's desk. The
30 days begin five days after the notice on the letter. It's
surprising that you haven't received a follow-up reminder.

Near the top of the 455, tell them the date you received the letter.
Enter your three most recent medical visits for any impairment that
contributes to your disability. However, you should also tell them
that you have an appt. Oct 21. Mail the form.

Thanks. I'll get this right out. This is the second or 4rd short form I
have received in the past decade or so. I'm over 55 and still disabled
since 92.

The mail here is sketchy sometimes and a neighbor might have been sitting
on it for all I know and finally gave it to the postman.

I have appts on 10/18 and 10/21 with doctors for my disability. They just
happened to fall within the same week this time around.

The last series were about 6 months ago.

All notices dated August 13th were mis-dated. I got one too. I

This seems to be the case.

A gent over age 65 in my neighborhood told me a recent standard doc sent
to him recently was similarly dated with the Aug 13 date. Must be a
computer glitch.

Anway... sent it back today to be certain. I had all the data in hand.

I got my first one of these short CDRs, too. Same date weirdness as
well. Will I hear back from the SSA even if they decide not to do a
full review? And about how long does it take them to decide? I see so
many docs for my illnesses the form was simple to complete. My health
is about the same -- some things worse, a couple things very slightly
better -- and my doc and I recently had a discussion about my working,
where she said she still agrees with her prior assessment that I can't
work. What's the likelihood the short form will be the end of this
reevaluation, and how do I know the frequency of these reviews? My
award letter said I would be reviewed in three years, and this one's
right on schedule.

Procedure instructs them to tell you if your case will not reviewed at
this time. Screwups do happen occasionally and the beneficiary is not
notified, but this is the exception rather than the rule.

When you filled out the short form questionnaire, you should not have
said that any impairments has improved. This is purely a subjective
opinion on your part and you cannot be held accountable. When you
tell them that an original impairment has improved, you run a greater
risk of CDR.

5% of them are selected randomly and are sent for full medical reviews
regardless of your answers. Of the remaining 95%, only 2.5% of them
result in CDRs. Your answers are the primary factor in determining
whether they do a CDR.

If your case is deferred, it will automatically be sent back into the
system for a 3-year call-up. When the system pulls up your case in 3
yrs., they enter some profiling data into your case to decide whether
you should get a the short form questionnaire again, or an actual CDR.
Of course, if your DDS is backlogged with initial cases, all of this
could be delayed.

Sorry, I should have been clearer. I checked that my health is the
same. The couple things that are "better" are not better enough to
really say so, and there are other things that are worse. Further, I
also have a few new diagnoses. Of those things that are worse, I didn't
feel they were bad enough to justify my saying my overall health is
worse, so that's why I said I was the same. Since I filled out the
form, I've had a flare, so today I'd have to say my health is worse. It
was a difficult question to answer, especially as I still have
difficulty with just daily living activities.

Unsure of the time but several weeks at least. It will be a letter
stating they still find you disabled.

They may cjheck last appointments to make sur ethat you are still seeing a
doctor and if all the ducks line up they may pass you along as continued.

They have done that a few times to me already.

One time they opted to send me for a psych exam but that was all. That
was at least a decade ago.

They won't contact your MDs unless they decide that they're going to
do a CDR. This depends on your answers on the 455 short form (except
for the 5% of 455s that are randomly selected for CDRs).

Hi, Out of curiosity have you heard anything back yet. I am "due" for
a review next month. I was wondering if everyone is getting their
reviews and short forms on their expected diary date or if they came
later and by how long? I have read in many places that CDRS are
backlogged for at least a year and a half and at some huge ridiculous
number. Just wondering if you are all getting them on your actual
diary date?

My CDR short form arrived a couple months before my three-year mark. I
completed it immediately and returned it, and just yesterday I got a
response saying they would not be reviewing my case "at this time." It
took about a month and a half to receive this response. Phew.

There was no info on it about when my next CDR is due. I vaguely
remember reading sometime ago that there are different codes for whether
we're reviewed at three years or seven years, and I *thought* these
codes were on the letter received from SSA. But ... no mention of
anything like that. The letter just said they don't need to review my
case/contact my doctor "at this time." Maybe you only see these codes
if they do a full review?

Jack responded to my query in a previous thread, and IIRC, he said it
should be another three years when I receive the CDR again.

So ... from my limited experience, no backlog here. Anyway, I'm
relieved they won't be doing a full review now.

Margaret, thank you for the information and congratulations. I am
glad that you were passed through without a full review. I am
starting to believe that the things I have been reading about a
backlog on CDRS isnt really a backlog in short forms but rather a
backlog in the short forms that are selected for full CDRS or the
short forms are more a formality to check for blatant improvements and
pass people through at a quicker rate in hopes to eliminate the full
CDR backlogs. Not sure on that but seems to make some sense. It would
be interesting to hear from anyone that has gotten a full CDR also.

I am curious about your three year mark. Was your three year mark
from the date determined to be your onset, the date you actually won
your disability case/benefits started or the date that your medicare
eligibility started. I am most certain that I am on a three year
diary date MIP. Whats odd though is it has been 6 years since my
onset date, 4 years and 2 months since I was found eligible and
starting receiving benefits and 4 years since I received my medicare
eligibility. All of which are past a 3 year mark. I did ask SSA
about my diary date a couple years ago and they weren't sure, which
was odd. Than last year and I think they said either November or
December of 2010. I am debating calling them back to get an idea so my
anxiety doesn't flare up like it has been about not being sure but I
don't know if that is a good idea to call.

The counting starts form the month of adjudication which is the same
month as the date on your notice or the previous month.

2. Diary Date
Enter a two-digit code for month, day, and year for 36 months in the
future, counting the month of adjudication. Use �01� for the day
(e.g., if the month of this decision is 3/02, diary for 02/01/05).

When the three years have matured, the system pulls up the case and
one of three things can happen:

1) If your DDS is backlogged with initial cases or MIEs, they could
put you on a back burner for an indefinite period.

2) If your DDS is not backlogged, they enter certain profiling data
and decide whether to do a:

A) short form questionnaire because they do not believe that your case
is a good candidate for CDR which can cost 10X as much as
questionnaire processing. Whether your questionnaire develops into a
CDR depends primarily on your answers. Over 90% of questionnaires
result in deferrals.

OR

B) CDR. If so, you will get the long form SSA-454.

3) Your case simply falls through the cracks. This would be rare but
it does happen. Some people have never been contacted after the
initial decision and ended up being converted to regular retirement
benefits.

No, not yet.

The short form with the bad date was sent back before Aug 23 and it is now
Nov 19, so we are into the 2 month area.

That may not be unusual however.

Thank you! It was a relief to not be fully reviewed, though strangely
enough I did not experience nearly as much anxiety when I received the
CDR as I did in the past when having to appeal my denial, testify at my
hearing, etc. I guess it's because my health is just as rotten as it
was way back when this whole disability thing started.

I waited over three years for my hearing, which was in November 2007, so
I guess reevals are three years from the date of the hearing and not onset.

I'm sorry you're having to deal with the anxiety of not knowing when
that CDR will arrive in the mail. I've heard that some people get them
right on schedule every three years, while others go many years without
receiving CDRs. Perhaps it's like jury duty? Some people get called
repeatedly while others never do. ;-)

I hope when you finally do receive your CDR, it goes as smoothly as mine
did.

I was one of those who received the Aug. 13 date but got it weeks and
weeks later. It was a mis-date. I sent off my short form answers and
it took 6 weeks to get the wonderful continuation letter. I know from
the codes on the Aug. 13 455 that I am rated as "low" for
improvement. I am age 58. It took 10 years for this first short form
letter to arrive. Jack can you tell me if I am a 7 year diary date?
By then I would be retirement age.

When there is a deferral, they are instructed to re-enter you with the
same diary date as previously. If they took 10 years, chances are
that you're a MINE (7 years). However, it's possible that you were a
MIP (3-year) but for some reason were delayed, e.g., computer glitch
or backlog of initial cases.

Here're two things you can do:

1) Contact the local office and ask them your diary category on the
SSA-833, item 23.

or

2) Read the references below. You'll see that except for certain
cancers most people at your age get MINES. However, the people who
process deferrals are clerks, not examiners, and if you were a MIP,
they'll arbitrarily MIP you again, according to their instructions.
When you read the sections, you should be able to infer what your
previous category was, MIP or MINE. The references below are what
guided the examiners when they made the initial determination.

I was age 49 at approval and have a mood disorder that began at age
25, but my retroactive proof only went back 2 years. According to the
POMS, I need to have had the disability for 10 years retroactively to
be initially a MINE. So I think I was a MIP but it took 10 years to
get a review. But now at age 58, a reviewer would classify me as MINE
because of my age, 10 year history of mood disorder and such.
So....you think the computer gave me the same 3 year diary? I am just
concerned because in 3 years I will be 61, still 4 years to go until
retirement. IF it's 7 years, then I will be retirement age. Thanks.

A disability examiner would classify you as MINE but if your answers
resulted in a slam-dunk deferral, a clerk would have handled it and
reinstated you within your previous category as stated in an earlier
post.

When a clerk has questions about your responses, (s)he bumps the 455
upstairs to an examiner. Look at the URL reference below and remember
what your answers were. This will give you some insight as to whether
your deferral was made by a clerk or an examiner.

Alternatively, you can call your local office and simply ask what your
category is on the 833. Some claims reps who dot all the i's and
cross all the t's play hardball and will make you file a formal
Privacy Act request, using the reasoning that this is technically
medical evidence, but most will simply convey this small amt. of info
over the phone.
