JERRY BROWN DISASTER IN CALIFORNIA

Here are just a few things Jerry Brown has done as A.G. or in his previous
stint as governor that are crippling this state and undermining the rule of
law.

1. As governor, Jerry Brown signed the law that created public employee
unions - special interests that, 30 years later, have so great a
stranglehold on public policy in this state that even such prominent
Democrats as Willie Brown and Bill Lockyer have begun to speak out about the
problem.
2. As A.G., Brown has sided with public employee unions in defense of an
unconstitutional retroactive pension increase. The issue, currently being
litigated in Orange County, involves estimates of between $300 and $500
million costs. Statewide, the cost of this illegal raid on the public
treasury has been estimated at about $8 billion annually.
3. As A.G., Jerry Brown has entered into a consent decree, rather than
fighting, onerous federal court orders demanding that we spend more money on
prison inmates. California already spends nearly $50,000 per inmate - more
than double the national average. And it spends more than $17,000 per inmate
on medical care, nearly four times what the federal government spends on
federal inmates. Federal Judge Stephen Reinhardt and a panel of 9th Circuit
Court of Appeals judges don't think California's expenditures are enough to
meet what they astoundingly claim to be the constitutional minimum, so the
Legislature has acted to order early release of felons back into our
neighborhoods. Thank you, Jerry Brown.
4. As A.G., Jerry Brown stood by while the Legislature attempted to raise
new taxes last year by simple majority vote rather than the two-thirds vote
required by our state constitution, as amended by Proposition 13. Happily,
my own law suit, on behalf of the Howard Jarvis Taxpayers Association and
the Republican members of the Legislature, helped put a stop to that illegal
action. But as Attorney General, Jerry Brown should have been alerting the
Legislature and the governor to the unconstitutionality of their proposed
action. He did not.
5. As A.G., Jerry Brown has not even attempted to appeal the federal court
orders blocking the pumps from sending desperately needed water to the
Central Valley, in an effort to avoid a speculative harm to the Delta smelt.
Livelihoods for a good number of our fellow citizens are at stake, but
rather than challenge the constitutionality of the intrusive federal
Endangered Species Act, Jerry Brown has done nothing.
6. And then there is Proposition 8. Rather than defending this duly-enacted
initiative of the people, as was his constitutional duty, Jerry Brown tried
to have it ruled unconstitutional by the California Supreme Court by
offering up a new "moonbeam" theory, never before heard, much less adopted,
by any court. And after losing in that venue, he has been siding actively
with the Plaintiffs, rather than defending California law, in the federal
suit currently pending in the federal court in San Francisco.
So the Moonbeam Governor wants to be governor again. His actions as attorney
general demonstrate that he is stuck in an ideological time warp of the
1960s and 1970s. It is time for a new tune for California. How about, "The
Times, They are a'changin!" And this time, let's send Jerry to an early
retirement, "sittin' on the dock of the bay" so the rest of us can be
"California Dreaming" of a golden state once again. Now that's Change we can
believe in!

Campaign Check: Lies and Half-Truths Outed

In an appearance last week on "Good Morning America," GOP
gubernatorial nominee Meg Whitman touted her targeted tax cuts for
employers and plans to streamline regulations to help keep businesses
in California. She called for eliminating the factory tax, which she
said "taxes manufacturers on the equipment they buy to manufacture in
California." As an example of job flight, she said, "We cannot
letNorthrop Grumman leave California."

Here's why company officials say Grumman left California for Virginia.
"As a global security company with a large customer base in the
Washington, D.C. region, this move will enable us to better serve our
nation and customers," said Wes Bush, chief executive officer and
president of Northrop Grumman. While 300 people from its corporate
offices moved, the company employs 30,000 people in California.

New Attack, Same Story: Meg Whitman Repeats Old Lies With New Pictures

Oakland - Republican Meg Whitman released the latest in her "Lie About
Jerry Brown" TV campaign today, repeating claims that have been proven
false by journalists and non-partisans like factcheck.org.

"Meg Whitman has refused to tell the truth about Jerry Brown from the
very beginning," said Brown Campaign Manager Steven Glazer. "From lies
about assaulting an employee at eBay to false claims about how long
she's lived in California to false statements about Jerry Brown,
Whitman seems incapable of telling the truth."

Whitman's latest ad repeats the false claims that Jerry Brown raised
taxes, that California lost jobs or that state employees gained
excessive benefits. Whitman's ad offers no specifics and no support
for those claims.

FactCheck.org finds Meg Whitman's attack ad "Fails to tell the truth"

Republican Meg Whitman is making false claims about Democrat Jerry
Brown's "lifetime in politics" in an attack ad. The two are battling
to become the next governor of California.

The ad claims that "crime soared" while Brown was mayor of Oakland.
That's false. The total number of crimes actually went down by more
than 13 percent.

Also false is the ad's claim that Brown "damaged the school system so
badly the state had to take it over." As mayor, Brown had almost no
control over the school district, which was run instead by an elected
school board.

That's the finding from a study released Monday by Stanford University's
public policy program, confirming a recent report with similar, stunning
findings from Northwestern University and the University of Chicago.

To put that number in perspective, it's almost seven times greater than all
the outstanding voter-approved state general obligation bonds in California.

Why should Californians care? Because this year's unfunded pension liability
is next year's budget cut to important programs. For a glimpse of
California's budgetary future, look no further than the $5.5 billion
diverted this year from higher education, transit, parks and other programs
in order to pay just a tiny bit toward current unfunded pension and
healthcare promises. That figure is set to triple within 10 years and --
absent reform -- to continue to grow, crowding out funding for many programs
vital to the overwhelming majority of Californians.

How did we get here? The answer is simple: For decades -- and without voter
consent -- state leaders have been issuing billions of dollars of debt in
the form of unfunded pension and healthcare promises, then gaming accounting
rules in order to understate the size of those promises.

As we saw during the recent financial crisis, hiding debt is not a new
phenomenon. Indeed, General Motors did something similar to obscure the true
cost of its retirement promises. Through aggressive accounting, for a while
it, too, got away with making pension contributions that were a fraction of
what it really needed to make, thereby reporting better earnings than was
truly the case.

But eventually the pension promises come due, and for GM, that meant having
to add extra costs to its cars, making its prices less attractive to
consumers and contributing to its eventual bankruptcy.

In California's case, past pension underfunding means reduced funding of
current programs. This explains why pension costs rose 2,000% from 1999 to
2009, while state funding for higher education declined over the same
period.
