Please excuse typos and such. In a rush to post this and operating on
little sleep...
This may be a long one, so I'll get to the meat quickly. On Friday 9/28/12
I was paid a visit by Bubba the Love Sponge's attorney and friend, Stephen
Diaco. Diaco showed up at my office in Saint Petersburg while I was out to
lunch. I got a somewhat frantic email from a staffer saying that three men
had come to visit me. They wouldn't talk to anyone else, and they wouldn't
say what they were there for. When told I was out to lunch, they replied
they'd be back. Sounded pretty ominous.
My office is not open to the public. It is an operations center. So it's
out of the ordinary when visitors show up unannounced. As I was rushing
back to work, I got a second email saying that the men had returned and
would wait for me. Soon after the second email, I entered my office through
a back entrance and passed through the employee break room enroute to the
lobby, as I did I saw an unfamiliar male wandering our break room as if he
was looking for someone. I disregarded him and rushed to the lobby. The
male from the break room followed me out. He intercepted me as I approached
the two seated males in the lobby. The two men with him stood, but never
spoke a word. They were big boys -- expressionless -- intimidating -- and
if I had to guess, they were hired muscle -- "goons", if you will. The
male from the break room introduced himself:
"I'm Stephan Diaco, and we know who you are"
For those new here, allow me to catch you up. For the past 14 months, I
have tweeted and blogged about Bubba the Love Sponge and his show. Almost
everything I have written about Bubba has been highly critical. Even
provocative. While I have utilized my right to free speech and enjoyed the
blanket of protection that our First Amendment provides, Bubba set his
sights on defaming and intimidating me. The well documented criminal
accusations that Bubba the Love Sponge Clem has repeatedly made against me
in social media, and on his syndicated radio show, in my opinion, serve no
other purpose then to incite his fans, the Bubba Army, to take action
against me -- on his behalf. In the past year, Bubba has fed his fan base
with the notion that I am a bad guy. A criminal even. This perception of
me, that has been instilled into the Bubba Army, by Clem, has become
ingrained into many of their minds.
The mindset that I believe Clem promotes is dangerous. Case in point: In
October of 2011 Bubba went on air on his number 1 rated morning show and
incorrectly identified a local political blogger of being "Ludlow". The
Bubba Army reacted swiftly, and the misidentified blogger, as well as his
family, endured 72 hours of harassment. Bubba's efforts to villify "Ludlow"
and incite his fan base was successful. The blogger stated in legal
documents that he experienced "emotional distress, grief, shock, and a
very real sense of fear regarding the actions of individuals who deem
themselves "Bubba Army" " There is no reason to believe that 12 months
later the same fate, or worse, is not waiting for me. Bubba has had that
much longer to convince his army that I am guilty of the various crimes
that he has accused me of.
Ironically, Bubba makes his living in large part because of the protection
that our First Amendment provides all of us. However, it appears that
Bubba does not appreciate this right as it applies to others. Especially
critics of the show like myself. He and his staff have engaged in several
failed attempts to silence me. The time and effort that has been put into
finding me is disturbing. This surprise visit by Diaco and goons was yet
another attempt to take away my voice.
I ushered the Diaco party outside of the building and we had a roughly 10
minute conversation on the sidewalk. Diaco wasted no time in issuing what
I took as a very threatening ultimatum. He told me that I had enjoyed my
"fun and games" and I better stop with them or else face "repercussions". I
was dumbfounded. Was I really being threatened on the street by this
attorney? I quickly asked him what he meant by "repercussions"? He replied
that I better just stop or I would face "legal recourse". Again, I'm
dumbfounded. I look back and forth at the two stone faced behemoths. I
asked Diaco what grounds they had to pursue "legal recourse" -- What
law(s) had I broken? He quickly rattled off that I had been stalking
Bubba, harassing Bubba, and exhibiting threatening behavior. I told him
that was ridiculous and denied all of the above. As the two body guards
stared me down, I asked Diaco if he felt threatened by me right now. He
responded that he did -- and again repeated his demand that I stop writing
about Bubba. This time his voice was elevated. It was at that point that I
realized continuing this conversation would not be productive. I
terminated the meeting. Before Diaco left, he scribbled his cell number on
his business card, handed it to me, and indicated that he would like to
talk again. Since our meeting, he has also emailed me, asking for my
decision. You'll find it below.
If this unannounced visit was an attempt at intimidation, as I believe it
was, it was a good one. If the intent wasn't to intimidate, why wouldn't
Diaco have called me? Emailed me? Wrote a letter? or used various other
legal methods at his disposal to deliver their message? Further, if Clem,
Diaco, and crew truly believe that I have acted unlawfully, as Clem and now
Diaco have alleged, why are they visiting me at my office instead of
calling the proper authorities? I've got a lot more questions, but they can
wait.
I spent that weekend talking with family and close friends. I was bombarded
with well thought out advice on how to proceed. I was humbled by the
kindness and various forms of support that was extended to me. Still am.
You see, I was rattled and if I'm being totally honest, I have to admit I
considered caving in to Diaco's demand that I shut down the blog, the
twitter account, and walk away. I couldn't help but think back to what
happened to the first guy who was accused of being me. And then to the
threats I have received, both from Clem and the Bubba Army. There is clear
and documented history of what happens when Bubba "outs" someone. I
questioned if it was all worth it. And I've concluded - it is...
While my intention is not to over dramatize the situation, the fact of the
matter is, better people then I, then Clem, then Diaco, have given their
lives to allow me the right to free speech. I'm simply not going to let a
bully take that away from me. And anyone who is working towards silencing
me should be ashamed of themselves and reassess their priorities in life.
I am a critic of a public figure. Considering everything else that is going
on in Clem's life, I shouldn't even be a blip on his radar. Yet amazingly
enough I am.
As Diaco made clear, I realize my decision to not disappear may bring
"repercussions". Regarding Diaco's threat of legal repercussions, I am not
concerned. Clem's and Diaco's claims that I stalked Bubba, harassed his
family, hacked accounts, or acted in any unlawful way, are flat out lies,
and I believe the accusers know they are lies. The veiled threats made by
both Diaco and Clem regarding my employer, have also been noted.
My primary concern is that I am convinced that it is Clem's desire to out
my personal information and allow the fan base that he has spent the last
year inciting with falsehoods, do their thing. He'll do this on his own,
as he did with the aforementioned political blogger, OR he will try to be
sneaky and work in concert with a third party to release it. When this
happens, I fear for my safety and that of my families and friends. I will
take what ever measures I must to protect myself and my family both from
physical harm, harassment, and from character assassination. To that end,
I have retained an attorney and am putting Clem, Diaco and anyone else who
wants to silence me on notice -- I will hold you legally responsible for
any damages, harassment, or harm that comes to me, or anyone close to me,
as a result of the false accusations that you have leveled against me.
Diaco will be receiving more formal notice shortly. I will continue to
maintain my blog and my twitter account. I will continue to act in a lawful
manner, and no one should ever feel threatened or harassed by me. I will
never make an effort to contact you or your families. If you read my
writings, it is because you seek them out. Not the other way around. That's
how it's always been and how it always will be.
Coincidentally enough, on the very same day that Diaco appeared at my
office, a new twitter account was created. The user behind the new twitter
account quickly began directing threats at me, and other critics of Clem,
promising that he had information regarding my identity that he would be
leaking. I've included some nuggets from his timeline below. He made it
known that his desire was to out me, and others, so that we could be
harassed. He even used the word "recourse", which is a word Diaco used
several times during our short conversation. Coincidence I'm sure.... And
did I mention that the account became active on the same day Diaco visited
my office? Something smells in Denmark.
Finally, for those wondering how I was tracked down, join the club. I have
come to find out that my information was released to Diaco by a financial
institution I do business with. One would assume that their personal
information would not be released to just anyone and that in order for
someone to obtain this info, they would have to have a subpoena or other
legal instrument. I'm certainly not a legal expert, so I don't know all the
ins and outs, but my attorney is very interested in discovering how Diaco
accomplished this. He mentioned "false pretenses" or something like that.
More on that later.
As I have offered before, I will dispense some free advice to Clem and
others. The great thing about social media is that it gives everyone a
platform. It also give us the ability to filter out those viewpoints that
we don't want to read or hear, for whatever reason. If you come across
opinions that are offensive to you, simply filter them out. Block the
content, move on, and allow everyone a voice and a platform.
