Sir,
I want to know what is the time allowed for getting the construction done on the plots where possession has been given by YEIDA. As it is a remote are, how can we go for construction/completion in next 2 or 3 years. I think we should get atleast 10 years for obtaining completion certificate. Most of the people go for temporary construction which is wastage of money. Allottees may share their views on this issue

Construction /Completion time should be 3 years after metro ready(or other public transport), school, hospital and commercial market....very basic idea from my side.

In this case Association can submit memo to yeida that it's members will not take possession untill all internal and external development activities are not competed or individual may write down on acknowledgement that he is taking possession under protest subject to completion of such and such pending development activities. Then he may seek extension of time and in case denied can go in court. But if possession is acknowledged without any objection you can't go in court for any deficiency of yield as laid down by Supreme Court.

I fully agree with u. Three years is grossly inadequate and wastage men, money and material. Planned development could start only after the area is habitable,

2,3 years are enough time get completion. If authority gives 10 years it will remain jungle and people will further request for 2 years extension. The cost of these plots will increase only after population will stay there

Dear Mr. Agarwal,
 
The time for construction provided by Yamuna Expressway Authority is 36 months, as opposed to 30 months provided by Noida and Greater Noida Authorities.
 
I was told, 6 months extra was provided to accommodate any delay in delivery after letter of invitation to execute lease deed is issued.
 
Personally, I think 36 months is more than sufficient for arranging resources to construct the house / minimum construction. Also, now minimum construction has to be of good quality. Neither of 3 authorities allow temporary or semi-permanent structures anymore.
 
As for 10 years or 5 years or 20 years... each of us will have individual opinion about it. But please do understand that no city will ever develop if it takes 10 years to provide physical possession (due to litigation) and then 10 years are provided to construct. That can go on forever and no one will ever benefit from it... neither the end user, because no one would like to live alone in isolated area and nor will investor benefit, because prices will not rise for an area which is forever empty.

We can see lot of semi permanent construction in Greater noida. How did they get completion certificate.
In sector 2 Greater Noida, i saw that most of the plots are lying vacant i.e. unconstructed. The allotted time is over. How are they managing.

What is the minimum area to be constructed.

21000 plots cannot be constructed in three years.

Do you find any possibility of extension of time.

Not to forget, we allowed 10 years to authority for delivery of plot. So authority should also be liberal.

On Authority website it is showing that 48 months are allowed.

Mr. Agarwal,

Too many questions in one go. Will try answer some.

Prior to 2015 NOIDA & GNIDA gave 60 months to construct and permitted 25% SEMI PERMANENT construction.

All that changed in 2015. Since then NOIDA & GNODA gives 30 months to construct and henceforth 50% PERMANENT construction is mandatory.

There was also talk of reducing time further and make 100% construction compulsory.

In Sector 2, some have gotten letter and constructed, some have gotten letter and they have done nothing, leading to penalties, and then there are some who still haven't recieved the letters.

Lastly, let me tell you what ex ACEO told me when I raised this point to him.

He said, it is the job of the government to provide shelter to those citizens who need one. Government take land from farmers, sometimes fights litigation for years and then provide the plots. 

He also categorically said, land allotted by government is not for long term investors. If you want to invest, do so in stock market or gold. Land by govt is for end users and that is the only focus of any government.

In a way, I completely agree. The sooner construction starts, the better for everyone. Or at least for most. 

10 years as being proposed by you makes no sense to me either. I have my plot there too. I don't want to wait for 10 years. Already soo late. Sooner the better.

Do you realize that you may have 10+10 years... some elders may not have that much time?

sir if due to some reason , someone is not able to construct in 36 months, then what is the penalty for late construction, as authority mentioned some 4%, 5% ,6% .
sir penalty on what amount, if some one have 300 sq mtr plot , then what exact amount as penalty will be.

Here is my view: 

Govt and builders will always want you to construct it as soon as possible. But without some mandatory infra like a police station, schools, hospitals, shops, community center, water and sewer, electricity power substation, bus stops, public transport, - most of them if not all - we cannot live there.

If 21000 buildings are to be constructed in 3 years, contractors will have a gala time.

Is it practically feasible to construct 21000 buildings in 3 years. I don't think so.

Yeida should adopt a different approach than noida and gnida

Agreed what you said but in India, it's always like this and I don't think that this is going to change in Modi Government.  In Indian society, basic Infrastructure comes at last and biggest threat here is local villagers. We have seen so much crime in Noida and Greater Noida in the past.  If anyone wants to live there before 2024 then better to get arm license also for your family safety.

Agreed what you said but in India, it's always like this and I don't think that this is going to change in Modi Government.  In Indian society, basic Infrastructure comes at last and biggest threat here is local villagers. Agreed but what about if they will visit your place and take whatever they want. This is how these locals are and until govt control them, it's not easy to live in such a society.

In sector 2 Greater Noida, i saw that most of the plots are lying vacant i.e. unconstructed. The allotted time is over. How are they managing.

What is the minimum area to be constructed.

21000 plots cannot be constructed in three years.

Do you find any possibility of extension of time.

Not to forget, we allowed 10 years to authority for delivery of plot. So authority should also be liberal.

On Authority website it is showing that 48 months are allowed.

Although I agree with most of the replies given by Safalji but there are some additional points which need to be considered
1. Still lot of plots are under litigation and hence society is giving possession in phases only and hence there is a good possibility that lot of plots may be under litigation when someone's time for construction is coming closer. Hence construction time should be counted only when authority has given possession to atleast 75% of plots. Definitely I cannot construct my plots if plots in my vicinity are lying as such. It is very much required from safety point of view also if we do'nt consider other aspects.
2. As you mentioned ACEO, is it not his job also to ensure development of proper infrastructure before forcing allot-tees to force for construction. But unfortunately in India you can blame all including yourself but not the government. In fact it is the authority officials who have failed to develop the area because of extremely poor planning. Just inserting a clause does mot mean that they are absolved of their responsibilities.
3. We can use our YEIDA group also to impanel some reputed contractors who services could be taken during construction. Again it will be a win win situation for both as the contractor will get bulk business whereas allottes will be free from lot of tension.

In China and western world, infrastructure is built before people move in, however in India it is always ‘after’ , hence we have no choice (unless we go to court to get stay on timeline) we have to build the house . The colony would look like a ghost town for some time, but with time we will start seeing people on street. This is the way it is.

Calculations for 300 sq mtr plot

- 70% max permissible on 300 sq mtr plot.

- Min 50% of max required for completion.

Therefore...

(300 sq mtr x 70%) x 50%

210 sq mtr x 50%

105 sq mtr : Minimum Area to be constructed.

105 sq mtr = 1130 sq ft

Cost of construction @ current prices =  

Rs. 1000 per sq ft (low quality)

Rs. 1500 per sq ft (average quality)

Rs. 2000 sq ft (good quality)

Rs. 3000 sq ft (excellent quality)

These approximate costs includes all expenses, such as construction material, labour, authority fee (both occasions), architect's fee, labour cess, boundary wall, land filling and other charges.

- Same rates apply for other plot sizes.

- These costs are at current market prices. They will increase with times.

- Labour is increasingly getting hard to find. Max increase expected in labour cost, in the future.

I recd.letter in June end & 180 days given for lease deed. I submitted the lease paper in August 1st week & agent said that enquire about your file after 15-20 days personally as it takes time like 2 1/2 months for approving file in routine course. If agent will do the same then he asked 100 rupees per sq.mtr for approving file on its own. I m just waiting as I m in no hurry.

Yesterday i visit to the authority & there they tell document not enough. First you deposit tge pending amt.i.e.mentioned in the check list letter. As i have 143000 negative balance as on date so no lease rent required. Bt PLC is to be paid. So i deposit approx.77500 for this & photocopy of payment challan given to dealing hand Deepak Chaudhary. Now he said come after 20 sep.file will process from finance deptt.& you also pay registry amt.i.e.approx 5900 for plc etc.
I will go after 20 sep.for enquiry & registry work if possible in one day as yesterday half day wae exausted in enquiry & payment of pending dues.

My case is same as of yours,i submitted all the papers as per check list in February.my all documents are complete.There is no objection in my file,but the employeee over there asking me 100rs meter for approval of file for lease.so what to do,it is necessary to pay bribe of 100rs meter to them.

Complain in writing per Registered Post as well s on email to the CEO/
OSD/ Property Manager that there is no objection in your file. but the
approval of file for lease is pending for lat XX days.

After 30 days complain to Chief Minister on Jan Sunwai Portal

Hello Nitinji,
After giving necessary documents as per check list and paid all pending dues I visit authority after 20 days. I contact to dealing hand Mr.Deepak. he is saying that your file is approved for lease deed so pay pendibg lease amt.in registrar office. Then I contact one adv.who is roaming there. He agreed to do that work in 6000 rupees but saying he will ready legal paper & we deposit the same in office as if he go tgen authority will ask bribe. So after depositing the paper GM sign in every page in front of me on that day after requesting so many times as he is busy in meeting with CEO. As the whole day exausted there, so we visit again at authority on some other day to deposit these documents to Sub registrar office. There after giving extra amt.as bribe to adv. As adv saying staff asking for money on each counter.we submit the docs.and visit again after one week to collect the lease paper and on the very sane day deposit all necessary docs with lease deed old and new one to authority reception with covering letter reqesting therein to give possession. Then enquire from dealing hand as well as project deptt.both giving same answer that we will receive possession letter after two months but approx 4 1/2 months passed no letter recd.till date. As i m in no hurry so i do not enquired about this.

after going through this discussion,I would like to simply submit that i have got my lease deed complete without paying a single penny.Nobody asked for a single rupee.I dont know who is asking for money in authority now.
if you are really facing such issue then issue should be raised with chairman yeida or write to CM.

Most of the advocates are hand in glove with authority people. They will try to extract as much money from you as possible.You do not have to pay any bribe to authority. Just make sure that your file is complete in all respects. Also, always remember to submit your file to the customer department of authority on the ground floor so that you have a proper tracking number. Your file then also comes under the view of higher ups in authority. The officials in authority are under pressure to clear up files on a timely manner by the higher ups.
