While the charge seems rather petty to pursue, the pedantic side of me asks, regarding:  "Section VII(G) of the CAC Election Rules states: "No person shall engage in any campaigning within 100 feet of the entrance of the building used by voters at the polling place during the time of the election the poll is open on Election Day.""

... Or what?  What remedy is written in the bylaws of the CAC?

P.S . My take is that the election committee erred in not properly posting
the boundaries for the polling location, Will made an honest mistake
because of this, Will immediately complied when told, and Will's offer to
cede the potentially affected number of votes is way beyond sufficient
resolution. Given that even the resulting count for Will would be on the
order of 2 times the next vote-getter, it seems inappropriate to nullify
the election.

I also read the report and saw no intentional violation of the rules by
Will Klatt, but did see a failure by the elections committee to post flags,
or cones, or a chalk line to indicate the area candidates should avoid.
As you noted, Will complied with the directive to move farther away.
Will won the election by an overwhelming majority. It would be an injustice
to Will and to the voters if the election was overturned. The election
committee's report should be upheld.
Here are the emails for the area commissioners. Note that the last one is
leading the charge against Will.
I also made some notes on each commissioner based on their on-line bios
and/or election materials. At some point, we may also want to contact them
regarding the ADU legislation.

Will Klatt here—Jeff added me last week so I could stay connected to any
issues affecting Walhalla and help advocate for the neighborhood.
 
As many of you know, I grew up in Walhalla and my parents still live there.
I now live on Lakeview with my wife Marla Son Geronimo (goes by MoMo) and
daughter Maylou, but I walk the ravine several times a week, often in the
evenings. It’s my place to relax, recenter, and appreciate the serenity of
our community. I want to help ensure it remains a safe, accessible, and
wonderful place to raise a family.
 
I didn’t want to raise this on the list, but I do want to be transparent:
some commissioners have tried to disqualify me after I won the election,
and now are pursuing a rerun after those attempts failed. Not all
commissioners are involved in this, and I appreciate the hard work Donna
and others put into serving—often a thankless role. My main frustration is
that I asked neighbors to take time out of their busy lives to vote, and
now some commissioners are openly suggesting those votes be disregarded
simply because they don’t like me or my views. In America, disenfranchising
voters is not a remedy for disliking the outcome of an election.
 
That said, my priority is keeping the focus on issues facing the ravine. If
you’d like to talk about the election, I’m happy to chat off-list.

You are correct. There is probably no consequence in the rule. But from what I understand Mr Klatt was clearly nowhere even close to 100 feet away from the building. CAC has spent years rebuilding trust in this community. I would hope that Mr Klatt can admit he didn’t follow the rules but that he will be more careful in the future. If we can’t trust those of us in this small community, what hope is there for our country?

Interesting, I’m not on Facebook so didn’t know about this, or know about the election. Which is why I appreciate this email group. 

Not taking sides just pointing a few things out that may be helpful... The “Election Rules” state that “Before the Committee certifies the election results, the Committee shall disqualify a potential candidate or candidate who is ineligible to serve due to death, withdrawal of candidacy, lack of residency, or any other reason in violation of these rules or rulings by the mayor or city attorney.”

“Shall” is some strong language. In the legal world that is a commandment, and means there are no other courses of action other than the options given. If a rule was violated, they clearly instruct the Committee how to proceed. Like the Rules or not, they say what they say, and it appears the Committee, if they found a violation, has no option but to disqualify a candidate. The Rules don’t distinguish between petty or egregious violations. 

The Rules instruct that “No person shall engage in any campaigning…” The Rules clearly distinguish “person” and “candidate” by the context in which they are used throughout this poorly drafted set of Rules. My legal argument would be that the Rules prohibit persons, but not candidates, from campaigning within 100 feet of a polling location. There are no terms defined in the rules, which is unfortunate, and leaves a lot of ambiguities to complicate situations like this. If “persons” included “candidates,” it ought to define the term and say so. 

One might also point out that the “violation of these rules” didn’t render the candidate “ineligible to serve.” As the Rules are written, it seems like the violation would have to render the candidate ineligible to serve, whatever that means, as that’s not defined anywhere. If it means in this case he wouldn’t have had enough votes to be elected discounting the 8 people he talked to, then that would make sense. But that’s not what happened.

Also, the test they use to weigh the seriousness of the violation in Section III of their decision doesn’t appear to be found anywhere in the CAC Bylaws or the Rules. Would be interesting to know where that came from - as it seems contradict the Rules, because the Rules don’t allow for a factors weighing analysis like they used, but are written with a strict liability inference.

I hope this turns out the way it should. Best of luck to those aggrieved by this.

Dave Ungar -- in order to disqualify, the offense needs to be egregious and intentional. Staying too close for a short time, when nothing was marked as is typical in other voting arenas, moving when informed, hardly sounds intentional and egregious so as to disqualify the overwhelming winner of the race.
