Smoking and noise issues on 3rd floor in Savier building

Board members. Important for us to use this email forum to address this problem.

To recap recent events:

The smoking continues. The noise continues. All emanating from Unit 304.

Resident in Unit 300 and I have filed complaints: 3 for Smoking, 2 for Noise. One warning has been delivered for each. One fine levied and on the day it was leveled, there were more violations. Coincidental?
Resident in 300  has recorded the noise coming through wall at loud level at approx 11pm, sounds of people screaming. Very loud. Resident in Unit 300 is a writer. The adjoining wall with 304 is in study and resident's work is significantly impacted.
Resident nearby is ALLERGIC to smolke (per her conversation with me). This has medical implications.

Process is slow for violations but this is extreme. Best option is for  resident in 304 to comply with BY-LAWS.. That is not happening. And when complaining resident discussed the issues with the resident in 304 who is smoking and making the loud noise, the resident is purported to have said 'change the bly-laws'.. 

Would love this to be amicable. It is not at this time.

I believe we need to find a suitable mechanism that adds urgency to the matter. Perhaps a discussion Jason (attorney)?

I'm up for elevating this issue to the lawyers and to much higher fines.   
I await Hal's decision on whether we approach our lawyer, and I, too, would like to have Jason on Zoom with the Board, if possible.
I'd like a new fine schedule to be a part of the agenda of our next Board meeting.  I'd like to see the fines double on each violation of the same violation after #3.

I fully support seeking legal advice as to how we should address this issue. I feel we should act well before the next board meeting (e.g., to have the owner(s) appeal the first fine or a set of multiple fines).
